How I Stopped Covering Up for a Hidden Wrong

I once belonged to a wonderful religion. I belonged to a religion that allows those of us who believe in it to feel that we are the greatest people in the world -- and feel sorry for ourselves at the same time. Once, I thought that I truly belonged in this world of security, self-pity, self-proclaimed intelligence and perfect moral aesthetic. I thought myself to be somewhat privileged early on. It was soon revealed to me, however, that my fellow believers and I were not part of anything so flattering.

Although I was fortunate enough to have parents who did not try to force me into any one set of beliefs, being Jewish was in no way possible to escape growing up. It was constantly reinforced at every holiday, every service and every encounter with the rest of my relatives. I was forever reminded how intelligent my family was, how important it was to remember where we had come from, and to be proud of all the suffering our people had overcome in order to finally achieve their dream in the perfect society of Israel.

This last mandatory belief was one which I never fully understood, but I always kept the doubts I had about Israel's spotless reputation to the back of my mind. "Our people" were fighting a war, one I did not fully comprehend, but I naturally assumed that it must be justified. We would never be so amoral as to fight an unjust war.

Yet as I came to learn more about our so-called "conflict" with the Palestinians, I grew more concerned. I routinely heard about unexplained mass killings, attacks on medical bases and other alarmingly violent actions for which I could see no possible reason. "Genocide" almost seemed the more appropriate term, yet no one I knew would have ever dreamed of portraying the war in that manner; they always described the situation in shockingly neutral terms. Whenever I brought up the subject, I was always given the answer that there were faults on both sides, that no one was really to blame, or simply that it was a "difficult situation."

It was not until eighth grade that I fully understood what I was on the side of. One afternoon, after a fresh round of killings was announced on our bus ride home, I asked two of my friends who actively supported Israel what they thought. "We need to defend our race," they told me. "It's our right."

"We need to defend our race."

Where had I heard that before? Wasn't it the same excuse our own country had used to justify its abuses of African-Americans 60 years ago?

In that moment, I realized how similar the two struggles were -- like the white radicals of that era, we controlled the lives of another people whom we abused daily, and no one could speak out against us. It was too politically incorrect to do so. We had suffered too much, endured too many hardships, and overcome too many losses to be criticized. I realized then that I was in no way part of a "conflict" -- the term "Israeli/Palestinian Conflict" was no more accurate than calling the Civil Rights Movement the "Caucasian/ African-American Conflict."

In both cases, the expression was a blatant euphemism: it gave the impression that this was a dispute among equals and that both held an equal share of the blame. However, in both, there was clearly an oppressor and an oppressed, and I felt horrified at the realization that I was by nature on the side of the oppressors. I was grouped with the racial supremacists. I was part of a group that killed while praising its own intelligence and reason. I was part of a delusion.

I thought of the leader of the other oppressed side of years ago, Martin Luther King Jr. He too had been part of a struggle that had been hidden and glossed over for the convenience of those against whom he fought. What would his reaction have been? As it turned out, it was precisely the same as mine. As he wrote in his letter from Birmingham Jail, he believed the greatest enemy of his cause to be "Not the White Citizen's Counciler or the Ku Klux Klanner, but the white moderate, who ... lives by a mythical concept of time.... Lukewarm acceptance is much more bewildering than outright rejection."

When I first read those words, I felt as if I were staring at myself in a mirror. All my life I had been conditioned to simply treat the so-called conflict with the same apathy which King had so forcefully condemned. I, too, held the role of an accepting moderate. I, too, "lived by a mythical concept of time," shrouded in my own surreal world and the set of beliefs that had been assigned to me. I had never before felt so trapped.

I decided to make one last appeal to my religion. If it could not answer my misgivings, no one could.

The next time I attended a service, there was an open question-and-answer session about any point of our religion. I wanted to place my dilemma in as clear and simple terms as I knew how. I thought out my exact question over the course of the 17-minute cello solo that was routinely played during service. Previously, I had always accepted this solo as just another part of the program, yet now it seemed to capture the whole essence of our religion: intelligent and well-crafted on paper, yet completely oblivious to the outside world (the soloist did not have the faintest idea of how masterfully he was putting us all to sleep).

When I was finally given the chance to ask a question, I asked: "I want to support Israel. But how can I when it lets its army commit so many killings?" I was met with a few angry glares from some of the older men, but the rabbi answered me.

"It is a terrible thing, isn't it?" he said. "But there's nothing we can do. It's just a fact of life."

I knew, of course, that the war was no simple matter and that we did not by any means commit murder for its own sake, but to portray our killings as a "fact of life" was simply too much for me to accept. I thanked him and walked out shortly afterward. I never went back.

I thought about what I could do. If nothing else, I could at least try to free myself from the burden of being saddled with a belief I could not hold with a clear conscience. I could not live the rest of my life as one of the pathetic moderates whom King had rightfully portrayed as the worst part of the problem. I did not intend to go on being one of the Self-Chosen People, identifying myself as part of a group to which I did not belong.

It was different not being the ideal nice Jewish boy. The difference was subtle, yet by no means unaffecting. Whenever it came to the attention of any of our more religious family friends that I did not share their beliefs, I was met with either a disapproving stare and a quick change of the subject or an alarmed cry of, "What? Doesn't Israel matter to you?" Relatives talked down to me more afterward, but eventually I stopped noticing the way adults around me perceived me. It was worth it to no longer feel as though I were just another apathetic part of the machine.

I can obviously never know what it must have been like to be an African-American in the 1950s. I do feel, however, as though I know exactly what it must have been like to be white during that time, to live under an aura of moral invincibility, to hold unchallengeable beliefs, and to contrive illusions of superiority to avoid having to face simple everyday truths. That illusion was nice while it lasted, but I decided to pass it up. I have never been happier.

مراقبي الجامعة العربية إلى سوريا بين مجرم الإبادة الجماعية في دارفور و دكتور كل تبن!

وصلت بعثة مراقبي الجامعة العربية إلى سوريا، للاطلاع على الأحداث الجارية هناك، خاصة في ظل أحاديث عن ارتفاع أعداد الضحايا .الأعضاء المشاركين في البعثه عليهم الكثير من التحفظات بدءا من رئيس البعثة المتهم بتسهيل العديد من جرائم الإبادة الجماعية في دارفور إلى عضو مجلس الشورى السعودي المعروف بدكتور "كل تبن."فبين شخص معروف بانتهاكاته لحقوق الإنسان و عضو يرد على من يفكر بانتقاده شخصيا أو انتقاد دولته بمقوله سوقية من الصعب أن يتواجد أي أمل في أن تقوم البعثة بأي تأثير.

البعثة يترأسها الجنرال السوداني محمد أحمد مصطفى الدابي، الذي قد سبق اتهامه بتأسيس ميليشيا جنجويد المخيفة، التي وقفت وراء أسوأ الفظائع التي ارتكبت خلال الإبادة الجماعية في دارفور.

ووفقاً لما ورد بكتاب "دارفور : تاريخ جديد لحرب طويلة"، الذي أعده جولي فلينت وأليكس دي وال، فقد وصل الدابي إلى الجنينة، عاصمة غرب دارفور، في التاسع من شباط/ فبراير عام 1999، رفقة طائرتين مروحيتين و 120 جندياً.
وخلال فترة تواجده هناك حتى نهاية حزيران/ يونيو، دخل في عداء مع محافظ المساليت غرب السودان.
وقد أكد هذا المحافظ ويدعى إبراهيم يحيى، وفقاً لما جاء بالكتاب، أن تلك الفترة شهدت بداية تكون ميليشيا جنجويد، التي كانت تشارك في عمليات الهجوم والتفتيش ونزع السلاح والسرقة. وهي الأقوال التي تم تأكيدها بعد ذلك بخمسة أعوام من جانب أحد قادة جيش التحرير السوداني، الذي صرح لفلينت ودي وال بأن الأمور قد تغيرت في العام 1999، وأضاف في سياق حديثه " حيث انتهت في تلك الفترة ميليشيا قوات الدفاع الشعبي الحكومية وتكونت ميليشيا جنجويد وحلت محلها".
وفي حديث له مع فورين بوليسي، قال دي وال إن يحيى كان يمتلك من البأس ما يمكنه من التصدي للجيش السوداني. وأضاف " وَجَدَت قيادة الجيش تلك الميليشيات مفيدة ومخيفة بشكل متساو. لذا عملت جهود إعادة تنظيم الصف التي قام بها الدابي للميليشيات العربية كخطوة تتيح لهم كبح جماحها، وإضفاء الشرعية كذلك على أنشطتها والاحتفاظ بها كقوة ضاربة في المستقبل".

أما الأستاذ الدكتور عضو مجلس الشورى غير المنتخب عبدالرحمن العناد فهو معروف في الأوسط السعوديه بدكتور "كل تبن." الدكتور هو عضو مجلس الشورى، وعضو الجمعية الوطنية لحقوق الإنسان بالمملكة، و محاضر حول مفاهيم حقوق الإنسان، وخاصة مفهوم حرية التعبير، وما يتعلق بالإعلام والصحافة في هذا السياق. في ديسمبر من عام ٢٠١٠، أتهم الدكتور أحد سجناء الرأي في السعوديه بخفة العقل عبر تويتر. رد عليه محامي السجين مطالبا بالاعتذار. فما كان من الدكتور الفاضل إلا أن طلب من المحامي أن يصمت بطريقه أقل ما توصف بأنها سوقيه "كل تبن". الجملة هي شتيمة بلهجة السعوديه. عندما سأله شخص، بطريقه تهكميه، عبر تويتر عن مصدر شهادة الدكتوراه التي يحملها، رد الدكتور الفاضل بعنصريه نتنة و أتهمه في رجولته! لاحقا أتهم الفاضل المسؤولين القطريين ب" التياسه". و من مبدأ العنجهيه و العزه بالإثم، قام الدكتور بعد الحمله عليه بالطلب من أي من ينتقد الدوله أو الوطن بأكل التبن.

نسي الفاضل أنه موجود في منصبه لخدمة الشعب. راتبه الشهري الكبير يأتي من أموال الشعب. وظيفته يمكن أن توصف بأنها خدمة العملاء. الشعب السعودي هو من يحلل راتبه و يحرمه بناءا على مدة جودة الخدمة. وجوده في هذا المنصب (دون أي انتخاب) يعني أنه يجب أن يتحمل قسوة الشعب عليه و لا يعطيه أي سلطة لكي يعاملهم كاتباع و رعية .

أي أن اللجنة تشتمل على عضو عنصري، عنجهي، بذيء اللسان، قليل الأدب مع من يخالفه الرأي، لا يقبل أي انتقاد للبلد أو الحكومة.

من المضحك المبكي أن من واجبات أعضاء اللجنة أن ترى مدى سماحة الحكومه السوريه مع المعارضين الذين يخالفونها الرأي. من واجباتها الأخرى أن تنظر في مدى انتهاكات حقوق الإنسان التي ارتكبتها الحكومه السوريه. الأشخاص الذين أوكلت أليهم هذه المهمه أحدهم متهم بتسهيل عمليات إبادة جماعية و الأخر عنجهي، عنصري، يصف من ينتقده أو ينتقد حكومته بأشنع الألفاظ السوقيه. يقول المثل في منطقة الأحساء "يا عوير يا زير ولا أشين من هذا إلى هذا." و العزاء لإخواننا في سوريا.

مشاهدة النساء للرجال في القنوات الدينية مخالفة شرعية و يفتح مجالا للفتنة

عضو هيئة كبار العلماء يفضل عدم وجود القنوات الفضائية في المنازل لأنها فتنه. لنحلل الخبر فقرة فقرة.

اولا يقول

لا شك أن هذه أمور مستجدة وطارئة على المسلمين، والأمة على مرّ العصور إلى زمن قريب عاشت من دون هذه الآلات والوسائل مكتفية بما جاء عن الرسول صلى الله عليه وسلم، ثم حصلت هذه الأمور وتعلق الناس بها واشرب في قلوبهم حبها

يعني ان مكيف الهواء و السيارات و المباني الخرسانية هي أمور مستجدة و طارئة على المسلمين و يجب على الأمة أن تعيش متكفية بما جاء عن الرسول صلى الله عليه وسلم.

نصيحته للأمة:

أما من استطاع أن يعيش من دونها واستطاع السيطرة على من تحت يده من النساء وان يختصروا على ما كانت عليه الأمة قبل ذلك، فلا شك أن هذه العزيمة والسلامة لا يعدلها شيء

يعني اتركوها فانها منتنة. الأمر الآخر: السيطرة على من تحت يده من النساء! اصبحت النساء متهمات بلمكر ويجب السيطرة عليهن لأنهن إذا تركن لوحدهن سوف يفسقن لأنها طبيعتهن البشرية. كما أن طبيعة الرجل البشرية تجعل كالحيوان ينقض ولا يفكر.

ثم يقول:

داعياً النساء في بيوتهن اللاتي يسمعن المحاضرات والخطب والندوات في تلك القنوات إلى «شيء من التخن» لأن ممن يلقي ويتكلم ويخرج في هذه القنوات من قد تفتتن به بعض النساء.

يعني يجب على النساء غض البصر عند مشاهدة هذه القنوات.

ما أقول إلا عجبي.

صحيفة المرصد: فضّل عضو هيئة كبار العلماء الشيخ عبدالكريم الخضير عدم وجود قنوات فضائية توصف بأنها دينية في المنازل، مشيراً إلى أن من تلقى العلم عن طريق تلك القنوات يحصل له خير، لكن لا يسلم من شيء من المخالفة من نظر النساء للرجال. وقال الخضير رداً على سؤال عن رأيه في إحدى القنوات الفضائية الدينية، وفيمن يرفض دخولها منزله، وذلك خلال لقاء مفتوح في جامع عثمان بن عفان في حي حطين بالرياص: «ارتكاب أخف الضررين مقرر في الشرع، واقتني هذه القنوات التي فيها الخير الكثير ولو أن فيها شيئاً مما يلاحظ». وأضاف بحسب صحيفة "الحياة": «لا شك أن هذه أمور مستجدة وطارئة على المسلمين، والأمة على مرّ العصور إلى زمن قريب عاشت من دون هذه الآلات والوسائل مكتفية بما جاء عن الرسول صلى الله عليه وسلم، ثم حصلت هذه الأمور وتعلق الناس بها واشرب في قلوبهم حبها، وصاروا لا يمكن أن يستغنوا عنها في الغالب، أما من استطاع أن يعيش من دونها واستطاع السيطرة على من تحت يده من النساء وان يختصروا على ما كانت عليه الأمة قبل ذلك، فلا شك أن هذه العزيمة والسلامة لا يعدلها شيء».

ولفت إلى أن في هذه القنوات فائدة ومصالح وعلوماً وفتاوى وكتباً علمية يستفيد منها الناس، لكن من أراد العلم وأخذه من كتاب الله وسنة نبيه على ما مضى في عهد هذه الأمة من السلف الصالح، داعياً النساء في بيوتهن اللاتي يسمعن المحاضرات والخطب والندوات في تلك القنوات إلى «شيء من التخن» لأن ممن يلقي ويتكلم ويخرج في هذه القنوات من قد تفتتن به بعض النساء. وتابع: «أن من يتلقى العلم عن طريق القنوات يحصل له خير، ولكن لا يسلم من شيء من المخالفة من نظر النساء للرجال»

لا تمنوا علينا بأموالنا

برزت منذ أحداث رمضان قبل الماضي (أغسطس/ آب 2010)، وما بعد ذلك وحتى الآن نغمة جديدة متداولة وغريبة وهي تقوم على نظرية محاسبة الأفراد ومعايرتهم من وجهة نظرهم بما حصلوا عليه من الدولة من خدمات في الصحة والتعليم، وبشكل عام البنية الأساسية.

أصبح البعض يتحدث لك ويقول، لماذا تفعل كذا وتطالب بكذا وإن الدولة هي من صرفت عليك منذ صغرك وعلمتك وأرسلتك للخارج للدراسة، ووفرت لك الرعاية الصحية والطرقات وغيرها من الخدمات؟

عبارة «على نفقة الدولة»، أصبحت منتشرة متداولة لكل من هو متهم حالياً، كيف فعلتَ ذلك وأنتَ من حصلتَ كل شيء على نفقة الدولة، لماذا تطالب بحكومة منتخبة، ودوائر عادلة وحرية ومجلس نيابي كامل الصلاحيات؟ لماذا تخرج إلى الطرقات في تظاهرات ومسيرات ضد الدولة، وهي من صرفت عليك؟

«على نفقة الدولة» تعلمت، «على نفقة الدولة» سكنت، «على نفقة الدولة» تعالجت، «على نفقة الدولة» ابتعثت، «على نفقة الدولة» حصل أخوك على سكن، «على نفقة الدولة» كان منزل أبيك من بين مشروع «الآيلة للسقوط»... والقائمة تطول.

مَنْ يُنفق على مَنْ؟ ومِنْ أين جاءت الدولة بهذه الأموال التي يقال عنها إنها تنفقها على الشعب؟ وما هي المهنة التي تمتهنها الدولة لتحصل فيها على المال ومن ثم تصرفه على شعبها لتمنّ به بعد ذلك عليه؟

مال الدولة يطلق عليه «مال عام»، وبالمختصر هو مال الشعب، من خيرات هذه الأرض التي نعيش عليها، وكل فرد في هذا الوطن يتسلم أجره كبيراً أو صغيراً، ومن إنتاج وعوائد خيرات هذه الأرض، ولا يوجد على هذه الأرض من يمنّ على أحد فيها.

ما يُصرف من خدمات في التعليم والصحة والإسكان والطرقات وغيرها، هي من الأموال العامة للشعب، وبالتالي فكل أفراد الشعب من حقهم الاستفادة من هذه الأموال والخدمات، دون أن يمنّ عليهم أحدٌ بها، فهي ليست ملكاً له، ولا ملكاً لمؤسسة أو سلطة، بل هي ملكٌ للأمة ذاتها.

الدولة عبارة عن شعب وسلطات (تشريعية، قضائية، تنفيذية) تعمل على إدارة المال العام وفقاً للدستور الذي ينص على أن «الشعب» (الأمة) مصدر السلطات. وبالمختصر المفيد فإن الدولة تعمل لدى الشعب، وظيفتها إدارة أمواله وخيرات بلاده، وعلى ذلك يتسلم كل من في الدولة، أجره على ذلك كاملاً نظير عملٍ يقوم به أو خدمةٍ يؤديها، كما يستفيد من الخدمات التي تقدمها.

فلا يحق لأحد أن يمنّ على أي فرد من أفراد هذا الشعب بما يناله من أجرٍ أو خدمات. وما نعيشه من خير فهو من خير أرضنا التي وهبها الله النعمة والثروة، وليست من خير أحد غيره سبحانه وتعالى.

أن يتعلم المواطن ويتلقى الرعاية الصحية ويستفيد من الخدمات التي تقدمها الدولة بالمال العام، لا يعني أبداً ألا يطالب بحقه، وحريته، وكرامته، وألا يطالب بالعدالة والمساواة وعدم التمييز، فكل تلك المطالب تأتي من أجل حماية المال العام أولاً وأخيراً، وحماية الدولة نفسها. فلا تمنوا علينا بمالنا

Say No to John Timoney in Bahrain!

أعلنت الداخلية البحرينية عبر حسابها في تويتر أنها في المراحل الأخيرة من التعاقد مع "جون تيموني". هذا الشخص ذو التاريخ المخزي في التعامل مع المتظاهرين

لقد قام "جون تيموني" بتطوير نموذج ميامي في التعامل مع المتظاهرين خلال عمله كرئيس شرطة ميامي و الذي يتضمن استخدام قنابل الغاز، رشاشات الفلفل،الغاز مسيل الدموع، الرصاصات المطاطية، و الهراوات لتفريق المتظاهرين السلميين مما أدى إلى مقتل أحد المتظاهرين في عام ٢٠٠٣.

بعد أحدث عام ٢٠٠٣ في ميامي، أحد القضاة الذين باشروا القضايا التي رفعها المتظاهرين ضد الشرطة قال "هنالك لا يقل عن ٢٠ جنحه قامت بها الشرطة ...تصرف الشرطة هو عار على المجتمع بأكمله."

بين عام ٢٠٠٧ و ٢٠٠٩ ثبت تورطه في قضايا استغلال غير مشروع للسلطه مما أدى إلى استقالته من شرطة ميامي.

من المفترض أن يتم استغلال المال العام لاستقطاب الخبرات التي تثري البلد. لكن الحكومة قررت أن تدفع أموالا لاستقطاب خبرة شخص لديه تاريخ مخجل من انتهاك حقوق الإنسان، مكروه في بلده، أجبر علي الاستقالة من عمله أكثر من مره لسوء استغلاله للسلطة، و يطلق عليه لقب "أسوأ شرطي في أمريكا

أهذا هو الرجل و هل هذه هي الخبرة التي من المفترض أن تستقطب في هذاالوقت الحرج من تاريخ البحرين.

Bahrain’s Interior Ministry announced on its own Twitter feed onThursday that it is in the “final stages of signing a contract withJohn Timoney. The notorious John Timoney with the shameful history ofpolice abuse.

He invented the violent and brutal “Miami Model” of crowd control whenhe was the Chief of Miami Police. His "Model" involves the heavy useof concussion grenades, pepper spray, tear gas, rubber bullets andbaton charges to disperse protesters. It resulted in the death of oneof the protesters during the Free Trade Area of the Americas summit in2003 and many more as more police departments started using JohnTimoney’s “Model.”

After the events of 2003, a Florida circuit court judge said he hadseen “no less than 20 felonies committed by police officers” andcalled the force’s actions “a disgrace for the community.”

Instead of spending the money on the general welfare, the Bahrainigovernment is spending the money to hire an “expert” who has a historyof violating human rights, despised in his country, and has beencalled “the Worst Cop in America!”

Bahrain is going through a critical period of its history. Adding JohnTimoney's "expertise" to the mix is a step in the wrong direction.Say no to John Timoney!

The latest AIPAC summit in Arizona reminds me of the famous religious healing video, where a woman on a wheelchair raises after the healer touches her head and prays to (Jesus, God ... etc). After few powerful words, the crippled woman (or man) stands up to a cheerful applaud from the audience, walking slowly with the support of the people around her at the beginning, then God's power kicks in and she starts walking normally.

Apparently, AIPAC is resorting to the same tactics to convince neoconservatives of the glories of (not God this time) Israel, not that they need to convince them. The neoconservatives’ blind support for Israel is mind-blowing when one considers the amount of dissent within Israel itself. Take this quote from Ann Lewis, the former Senior Advisor to Hillary Clinton, and former Director of Communications and Counselor to President Bill Clinton, reacting to President Obama’s preference for a less rightwing government in Israel: “The role of the president of the United States is to support the decisions that are made by the people of Israel. It is not up to us to pick and choose from among the political parties.”

We felt collective pride and awe as we saw a few examples of the amazing technology coming out of Israeli companies, including the Iron Dome missile-defense system and ReWalk, a powered exo-skeleton technology that actually enabled a paraplegic woman to rise from her wheelchair and walk.We were entertained by the playful political banter among Paul Begala, Bill Kristol, Mike Murphy and Ann Lewis.

I think this is an important point. One difficulty with the Israel issue is that American Jews of my generation and older tend to close ranks in support of anything Israel does. And really there's no difference between liberal Jews and rightwing ones, let alone Democrats and Republicans. Thus all the liberal Jewish Democrats who voted for the Iraq war, in part because Tom Lantos was calling Saddam "Hitler" because he backed suicide bombers. Thus Barney Frank, a big liberal, says he privately opposes settlements but he won't go public unless Jeff Halper can find 5,000 Jews in his district who will support him.

The AIPAC anecdote explains Frank's problem. His own sister Ann Lewis is a big liberal Democrat, close to Hillary Clinton, and she does a lot of work for AIPAC. She has said, "The role of the president of the United States is to support the decisions that are made by the people of Israel. It is not up to us to pick and choose from among the political parties."(per Dana Milbank).

Really is there any difference on this issue between Ann Lewis and Bill Kristol? Israel is the royal road to neoconservatism.

أحرارٌ، على خارطةِ السُّجونْ!

في وطني، خرائط الشرفاء مرسومة حول أسوار السجون، أولئك الذين بذلوا أنفسهم رصيدًا لحسابات هذا الوطن، الذين كافحوا وناضلوا وجعلوا لُحمته عنوانهم قبل الحياة، سيدوّن التاريخ أسماءهم بمدادٍ أبيض على لوحة صفحاتٍ سوداء، غلف بها المجرمون وجه الوطن!

ذنوبهم أنهم هجروا فرشهم لإصلاح سوءاته، وجرمهم المشهود أنهم بحثوا عن “الحياة” في أرجائه، وأنهم رفعوا نداءاتهم إلى مسامعه، ففجعنا فيهم الوطن بغياباتٍ بلا عودة، وتواروْا عنا وكأنهم لم يكونون! وعندما وصلوا إلى النقطة المضيئة في نهاية الطريق، وموعد المحاكمات، اكتشفوا أنها منفذٌ إلى خارج أرض الوطن، يهوي بهم في السجون سنواتٍ وسنواتْ.

في وطني، لا شيء أكثر مثالية وإتقانًا من الطريقة التي يُسرق بها أبناؤه، وتسلب مشاعر الحب والحنين إليه، ولا شيء أكثر جُرمًا من حبه، ومحاولة الانتماء إليه.

في وطني، يموت الفقراء جوعًا وهم في الطريق يلتمسون الطعام، غيبهم عن أنظارنا فساد المسؤولين، و”بشوت” الطغاة، كيف سيشعر الفقير والمسكين والعاطل بحب الوطن؟ وكيف سيترجم السجين شعاراته؟ وكيف ستحفظ الأم ودًّا للوطن الذي كان لحظة وداعٍ بينها وبين أبنائها؟ بل كيف سيبقى في قلب المرأة شيئًا من روح الوطن الذي غلف حياة زوجها بالسلاسل والقيود؟ وأنت،، كيف ستقترب من هذا الوطن، وأنت ترى مخالبه تنهش في أجساد الأحرار؟

كيف سنفرح بالوطن؟ وأمهاتنا يحذروننا عند أبواب المنازل “انتبهوا من السرعة، واحذروا من الوطن!”، وعندما نشارك في التوقيع على عرائض المطالبة بالإصلاح؛ فإنهن يخافون كأننا وقعنا على “خروج نهائي”.

صار مفهوم الوطن عندنا، هو المكان الذي – عندما نُتهم بالخطايا – نُحبس في أراضيه. وقبل أن يحمي أبناءه من الخارج؛ صار أبناؤه يستنجدون بالخارج كي يحميهم من عثرات هذا الوطن.

في وطني، تبدلت الأحكام والموازين، صار وطن الأحرار يقبع داخل السجون، وفي ثياب المتهمين، وفي جلسات المحاكمة، ويبقى يأس النساء والأطفال يملأ فراغات المنازل، بسنوات من الانتظار المر. فعندما قالوا أنه ربيع أوطان العرب، شاهدتُ الشعوب تزين أوطانها بوسام الحرية، وترسم شعاراتها في لوحاتٍ من الأمن والسلام، لكن وطني ما اكتفى أن يشوه لوحته، بل جعلها سوداء قاتمة، ملطخة بآلام الأحرار. وعندما نسافر بعيدًا عن حدود هذا الوطن، فنحن نشعر بحرية التعبير، وطلاقة التفكير، والمشاركة السياسية، ونشعر بمشاركة الآخرين فرحتهم في تشكيل أوطانهم، بينما لا نستطيع نحن أن نكون مواطنين داخل وطننا، فنشعر بالحنين لكل ما هو خارجه؛ لأننا حينما نسمع اسم الوطن، ترتبط أذهاننا بتعريف الظلم والفساد، وأماكن السجون!

لا تبالي ياوطني إن ضاعت أحلامنا بين يديك، فأجساد الأحرار ما زالت حبيسة القضبان، تنتظر منك أن تمسك بأيديهم وتعيدهم إلى أهليهم وزوجاتهم وأبنائهم، لا نريد منك سوى أن تنظر بعين العطف على حسرة أحبابهم، وأن تغفر لهم أنهم فكروا أن يبذلوا أنفسهم من أجلك. ولا تقابل تضحيتهم لك – يا وطني – بمخالب يديك، ولا تجعل حضنك لهم منفذًا إلى غياباتِ السجون.

مر علينا عيد الأضحي المبارك ولا احلي كان لي عيدين. عيدنا الذي نقدم فيه اضحياتنا ونستمتع مع امي الجميلة بكل تقاليد العيد الثابته التي حرصت جميلتنا مذ كنا صغارا على ان نعيشها من خلال اجتماعنا بعد صلاة العيد في بيتها مع اطفالنا واستلام الضحايا ودعوة كل بنت من بناتها أو زوج وزوجه من أبناءها ومع أولادهما لتسمية ضحاياهم وذكر الشهادة والتربيت على الخراف قبل التضحية بها !أصدقكم .... لا ازال أعيش هذا التناقض كل سنة ولا زلت أجد الخراف الخائفة ترفس وتسحب برجليها الى الخلف وتحاول التشبث بالأرض خائفة من النزول من السيارة الى مكان الذبح حيث تشم رائحة الدم وترى زميلاتها سقن قبلها للنهاية. ...... لم يكن هذا الحدث هو الشاهد اليوم رغم أهميته الحدث هو ان عيد هذه السنة صادف اليوم السادس من نوفمبر وهو اليوم الذي قامت فيه سبع واربعون أمرأة (وكنت إحداهن) بالخروج بشكل جماعي في مدينة الرياض للمطالبة بحق المراة السعودية في قيادة السيارة وذلك قبل عشرين عاما اي بالتحديد في السادس من نوفمبر 1990.يموج العالم اليوم بكم ممن التغيرات لم يشهدها بهذه السرعة او لعلنأ نقول لم يتوقعها لعقود ..هاهي أحداث العالم سريعه وغامضة ومركبة وسريه بطريقة أربكت ولا تزال مسار الأمم في سياساته واقتصادياته ومناخه وبتروله وشبابه . الكثير من ألأمم التي لم تعتد كيميائيات هذا التغير الذي باتت تعيش على وقعه بحيث لا يملك كل منا الا ان ينظر الى نفسه ويقول أين نقع نحن من هذه الكيميائيات المتفاعلة ؟ هل تذكرون ذلك التونسي الذي ظهر في شوارع تونس بعد سقوط بن علي وهو يصيح : لقد هرمنا لقد هرمنا... هذا نحن هنا مع هذه القضية الهرمة الفتية: لا تغادر عالمها ولا يتقادم عليها الزمن لكننا معها نصيح :: لقد هرمت.. لقد هرمت... ونحن نصرخ مطالبين بها....يضحك الكثيرون حينما يرون وضع المرأة ( مقارنة بنساء العالم ) فيقولون بسخرية ولماذ سواقة المرأة و هناك قضايا أكثر اهمية مثل مزيد من فرص التعليم المنوعه أو توفير مزيد من فرص العمل لهذا البحر الهائج من البطالة النسائية أو اصلاح النظام القضائي التعس الخاص بقضايا المرأة . نعم كلها قضايا مهمة بل ولعل أكثرها أهمية على الأطلاق في نظري هو قضية القوانين المتعلقة بالأحوال الشخصية للمرأة من زواج وطلاق وحضانة ونفقة وعذل وايذاء وحرمان الى آخره من هذه القضايا التي تمس كل أمراة مهما كان مستواها التعليمي او الأقتصادي. صحيح ان النساء ذوات النفوذ الاجتماعي يتمكن بمالهن او نفوذ اسرهن من التغلب على كثير من عثرات النظام واجحافه بحق المرأة مما يقلل من آثاره لكن ذلك لا ينفي اصابتهن المتنوعة... دع عنك النساء المتوسطات في التعليم والمستوي الاجتماعي أو الفقيرات فهؤلاء عليهن هن وأطفالن السلام حين يقعن ضحايا لأي مشكلة لها علاقة بالرجل اي كان دوره في حياتهن : أب او زوج او اخ او ابن أو وكيل . فأذن هي مشكلة حقيقية لكن يعظمها ويصعبها عدم قدرة المرأة على الحركة .. عدم قدرتها على الوصول الى حقوقها او التعرف عليها : عدم قدرتها على الوصول الى المصادر المتنوعة التي قد يوفرها السوق من تعليم او تدريب او وظيفة أو وسائل قانونية وشرعية للتخفيف من معاناتها . عجز المراة عن الحركة( المباشرة والمادية بقيادة السيارة ) يجعلها اسيرة لمن حولها فعلاقتها بكل الفرص المتاحة ومهما بذل الملك عبدالله من جهود خرافية لتثبيت وتوسيع حقها في التعليم والتدريب والعمل والمشاركة في الانتخابات فسيبقي ذلك كله مشروطاٌ بموافقة من حولها من الرجال على التنقل بها للأستفادة من هذه الفرص او على نوع قناعاتهم الفكرية وايمانهم بهذه المرأة التي حولهم . إذن فقيادة مركبة للتنقل من نقطة الف الى ب : اي هذا المشوار البسيط الذي يؤديه كل رجل على أرض السعودية منذ أن يصحو من نومه كل يوم لا يعني فقط رغبة من النساء ( الليبراريات ) في مزيد من الحريات للمراة بما قد يهدد بالمثالب كما يردد البعض!..انه ببساطة يعني تمكينا للمراة العادية البسيطة في قريتها او سوقها الشعبي او مدينتها الكبيرة من اتمام شؤونها وشؤون اطفالها واسرتها وجد حولها رجل داعم ام لا . بالمناسبة لنتذكر ان هناك مئات ألاف من النساء الأرامل والمطلقات والغير متزوجات ممن يحتجن أن يتنقلن لقضاء حاجاتهن دون ان يؤطر ذلك اي فكر له علاقة بحقوق المراة أو تمكينها كما ان هناك الآف الأسر الناشئة الجديدة التي يعمل الرجل فيها ضمن شروط العمل في القطاع الخاص بدوام يمتد الى الرابعة او السادسة والذي لا يسمح له العمل في هذا القطاع كما في القطاع الحكومي بالخروج كل يوم لاستلام ابناءه من مدارسهم عند الواحدة ظهرا فماذا عساه أن يفعل ؟ طرح موضوع ملتهب كهذا الان بهذه العلنية ( رغم رفض الجريدة الرسمية لنشره) وسهولة ايصاله الي مواقع أخرى تساعد على انتشاره دليل قوي على ان المجتمع يتغير وأنه يضم فئات متنوعة فيها من يقر بهذا الحق وقد يسعي لممارسته متي اتيح وفيها من يرفضه ويري شره ومن ثم سيقف منه موقف المتحفظ وهذا حقه وحقها ايضا فهناك الكثير من النساء لا توافق على فكرة قيادة المرأة وهذا من حقهن تماما. حق قبول الاختلاف مهارة لم نعتدها في مجتمع ظهر من رحم القبيلة حيث لا حق للفرد مقابل رأي الجماعه وتلاه نظم ثقافية وتعليمة وحكومية كرست مفهوم الرأي الأبوي الأوحد .ربما حان الوقت لنعترف ان أبناءنا لا يشبوهننا تماما وانهم يلبسون بطريقة مختلفة وتتنوع تفضيلاتهم للأكل من الصيني للياباني للسليق والحنيث والحنيني( هل سهوت عن احد الأكلات الشعبية المهمة لأي منطقة ؟) كما ان بعضهم يسمع موسيقى متنوعة وكلهم دون استثناء يجلسون ساعات الى النت بكل تنوعاته ويمارسون حريات مهولة ضمن منتدياته وتغريداته . هذا الجيل هو ما سيفرض علينا ان نقبل خياراته( المتنوعة بين المنفتحة والمتشددة ) ومن الحكمة الأبوية ان نقدم له هذه الخيارات( وابسطها قيادة المرأة للسيارة) ضمن شروطنا الدينية والثقافية و الاجتماعية وتحت رعايتنا وأن ننتبه وندرس حركتهم تحت الطاولة قبل أن يقلبوها علينا!

Unpacking the Israel-Kenya deal to help wage war in Somalia

The recent developments in Somalia is quite interesting. One wonders, why now? But that's not the question addressed here. It seems a bit odd for Israel to be involved in a war that it is so detached from. But is it? Israel is not supporting Kenya because it is the right thing to do, it's supporting Kenya in order to capitalize on the conflict. Israel has a long history of being the US "surrogate" when it came to supporting dictatorships during the Cold War, and this might be the new role it plays. One more point worth highlighting, Israel's massive war industry is the number one reason behind this so called support.

Mondoweiss's new staffer, Alex Kane reports:

Kenya's battle to fight al-Shabaab, the fundamentalist Islamist group in Somalia that has been tied to numerous suicide bombings, is set to be assisted by Israel. The BBC reports:

[The Kenyan prime minister's office] said Kenya got the backing of Israel to "rid its territory of fundamentalist elements" during Prime Minister Raila Odinga's visit to the country.
Last month, Kenya sent troops to neighbouring Somalia to defeat al-Shabab, which is linked to al-Qaeda.
It blames the militants for a spate of abductions on its side of the border.
In a statement, Mr Odinga's office quotes Israel's Prime Minister Benjamin Netanyahu as saying that "Kenya's enemies are Israel's enemies".

There's an important set of factors driving this deal, and it's worth unpacking some of them to explain why Israel is assisting Kenya.
First, Israel's massive war industry will benefit from Kenyan requests to "help Kenya's police force detect and destroy al-Shabab's networks...[and] provide vehicles for border patrols and equipment for sea surveillance to curb piracy off the East African coast." Israel has sold Kenya military equipment in the past, as ICAHD researcher and independent journalist Jimmy Johnson documents on his new website, but this deal will significantly expand that cooperation. Israeli arms companies will be profiting off a month-long war that has reportedly killed innocent civilians in Somalia.
Second, the deal is another opportunity for Israel to claim that its "enemies" are fundamentalist Islamists akin to al-Qaeda, as Benjamin Netanyahu has claimed. Netanyahu's claim is wrong (Hamas has actually cracked down on Islamist fundamentalists in Gaza) but it's a common trope pushed by the Israeli establishment and U.S. supporters of Israel in order to tie resistance to Israeli occupation to jihadist terrorism.
Third, the help is in line with broader Israeli attempts to "boost military sales in strife-torn Africa."
There is a history of Israel arming unsavory dictatorships and regimes around the world, from apartheid South Africa to countries in Latin America. As Phyllis Bennis writes in a chapter to Wrestling with Zion: Progressive Jewish-American responses to the Israeli-Palestinian Conflict, Israel acted as a "surrogate" for the U.S. during the Cold War in Latin America, Asia and Africa, assisting brutal dictatorships in those regions. Kenya is no dictatorship, but the alleged killing of civilians in Somalia and ongoing investigations into post-election ethnic violence that Kenyan leaders allegedly fomented make clear that Israel has not changed its attitude towards countries that commit human rights abuses--a logical attitude considering Israel's own war crimes record.
Meanwhile, al Shabaab has slammed the Israel-Kenya deal, and the Associated Press is warning of the potential blow back to Israel Somali militants could inflict. As more innocent Somalis die as a result of Israeli-assisted Kenyan military action, the risk for more bloodshed on both sides increases.

المرأه السعودية: مواطن من الدرجة الثانيه؟ أو الثالثه؟

تصريحات بعض المسئولين و المشايخ السعوديون قد تكون في بعض الأحيان (أو في الغالب ) مثيره للقلق. اليوم ننظرلتصريحات شيخ و مسئول كل منها ينضح بالنظره الدونيه للمرأه السعوديه لدرجة مثيره للقرف.

في تصريحٍ للدكتور محمد الخزيم، نائب رئيس شؤون المسجد الحرام والمسجد النبوي، قال فيه: "إن الرئاسة قد تفكر في إنشاء مسار خاص للنساء، على غرار المسار المخصص لذوي الاحتياجات الخاصة"!

لو رجعنا إلى أساس هذا التصريح فهو نابع من نظرية أن المرأه لا يمكن أن تؤتمن أو يؤتمن عليها في الأماكن العامه. فهي مخلوق يفتقد حسن التصرف في الأماكن العامه و أن الرجال ذئاب (حيوانات) لا تستطيع التحكم في تصرفاتها حين ترى المرأه. هذا رأي يحتقر الرجل و المرأه في ان واحد. من العجيب في بلد يدرس فيه الدين من بداية مراحل الدراسه أن تكون ثقافة الشك هي الأساس و ليس حسن التربيه!
المرأه في السعوديه تساوى بالذكور القصر و ذوي الاحتياجات الخاصة! ليس تنقييصا من ذوي الاحتياجات الخاصه ولكن رأي فضيلة الدكتور ان المرأه لمجرد كونها امرأه فهي تولد بإعاقه دائمه لا يمكن الشفاء منها!

نأتي إلى رأي فضيلة الشيخ: العلامه القرضاوي أرسل رساله إلى الملك عبدالله يزكي فيها على قراراته الأخيره و يحثه على "السماح للمرأة المسلمة بمزاولة القيادة واستقلال السيارة بالضوابط الشرعية كغيرها في بلاد المسلمين." رد عليه الملك ردا لطيفا. ثم استنكر الشيخ السعودي محمد بن سليمان البراك -أستاذ الدراسات العليا في جامعة أم القرى- دعوة القرضاوي مؤكداً أن علماء السعودية الموثوق بدينهم أجمعوا على التحريم. و قال "أن ذلك مرفوض شعبياً من النساء قبل الرجال، ولا يطالب به إلا فئام من المستغربين والمخدوعين الذين لا يشكّلون نسبة تُذكر من أبناء بلاد الحرمين".
بحكم ان الشيخ الفاضل هو الوصي الشرعي على النساء السعوديات وبحكم أن النساء السعوديات قصرمهما بلغن من العمر و بحاجه إلى وصي، فإن تعميم الشيخ بأن الأمر مرفوض من النساء قبل الرجل هو منطقي. أرجو من الشيخ أن يزودنا بالدراسات الإحصائية التي بنا عليها تعميمه. و كذلك أرجو أن يقدم لنا صك الوصاية الذي أعطته إياه النساء السعوديات قبل الرجال! رأي الشيخ ينم عن تسلط ذكري منتن. و كذلك ينم عن نظرة تعالي مقرفه. أصبح الدكتور القرضاوي ،بحكم أنه مصري مقيم في قطر، (لا أعلم لو كان مصري مقيم في السعوديه هل سيختلف الأمر أم لا) ليس من العلماء الموثوق بدينهم! و هل أجمع علماء السعوديه على التحريم؟ يبدو أن فضيلة الشيخ أستاذ الدراسات العليا يجهل أصول البحث العلمي فقبل أن يقوم الباحث بأي تعميم يجب ان يقوم بحصر الاراء و التأكد. نسي الشيخ رأي الشيخ الألباني. ولو قلنا أن الشيخ الألباني هو غير سعودي وبذلك ليس من العلماء الثقات تطبيقا لرأي فضيلة الشيخ فماذا عن رأي الشيخ أحمد بن باز؟ .

لا لاحتكار الرجال للحرم!
من الغرائب أننا أحيانا وفي بعض الآراء نسير إلى الخلف، نبتعد عن الرؤية العصرية إلى الرؤى الغريبة. في تصريحٍ للدكتور محمد الخزيم، نائب رئيس شؤون المسجد الحرام والمسجد النبوي، قال فيه: "إن الرئاسة قد تفكر في إنشاء مسار خاص للنساء، على غرار المسار المخصص لذوي الاحتياجات الخاصة"! مع أنه يعلم وذكر ذلك في تصريحه أن هذا الإجراء لم يمر على المسلمين طوال تاريخهم. الحرم المكي كان طوال تاريخه متاحا للجنسين من دون تمييز، في المطاف والمسعى، الفرق أن النساء يتأخرن في صفوفهنّ، أما الفصل بين الطائفين والساعين على أساس الجنس، فإن هذا يعد رجوعا إلى الوراء لغرس ثقافة الشك بين الناس. الغريب أن الدكتور قرن بين "النساء" و"ذوي الاحتياجات الخاصة"! وليته ذكر السبب. لأن المرأة كانت ولا تزال شريكة في العبادة وفي الواقع حتى على زمن النبوة. ففي صحيح مسلم عن أنس بن مالك أن رسول الله عليه السلام ذهب إلى قبا يدخل على أم حرام ـ أخت أم سليم ـ فتطعمه، فدخل يوما فأطعمته فنام رسول الله صلى الله عليه وسلم ـ وفي رواية الليث فنام قريبا مني ـ ثم استيقظ يضحك وهي تغسل رأسها، فقالت يا رسول الله أتضحك من رأسي؟ قال: لا، ولكن ناسا من أمتي عُرضوا عليّ غزاة في سبيل الله يركبون ثبج البحر مثل الملوك على الأسرّة، فقالت: ادع الله أن يجعلني منهم، فدعا. يعلق الدكتور راشد المبارك على هذا الحديث في ص33 و34 من بحث لافت حول "الاختلاط" نشره ضمن كتابه: "من قضايا المجتمع السعودي" قائلا: "والجدير بالذكر أن أم حرام هذه ركبت البحر مع الغزاة الذين جهزهم معاوية في إمرته على الشام في خلافة عثمان في السنة الثامنة والعشرين للهجرة، أو الثالثة والثلاثين.. وقد جاء في بعض روايات الحديث أن أم حرام كانت تفلي شعر رسول الله". قال أبو عبدالله غفر الله له: بمعنى أن إعادة قضية المرأة، وعودتنا إلى الوراء في التمييز ضدها إنما يعبر عن تقهقرنا في رؤية العصر واحتياجاته ومتطلباته. لتكن المرأة في الحرم كما كانت في السابق، من دون أي تمييز محدث، ولا أظنّ أن هذا القرار سيكون عمليا ولا مقنعا، ولا مقدّرا لإنسانية البشر، والبعد بهم عن مواطن الشك من خلال هذا الفصل والعزل.

رسالة الشيخ القرضاوي و رد الملك:

تلقى العلامة الدكتور يوسف القرضاوي، رئيس الاتحاد العالمي لعلماء المسلمين، رسالة من جلالة الملك عبد الله بن عبد العزيز آل سعود ، يشكره فيها على رسالته إليه، التي يثمن فيها الشيخ جهود خادم الحرمين في دعمه لدور المرأة المسلمة في المجتمع وفي الحياة السياسية وفق الضوابط الشرعية.
وكان الشيخ القرضاوي قد بعث برسالة إلى جلالة الملك يهنئه فيها على تصريحاته في حق المرأة المسلمة بالمملكة، جاء فيها:

بالإضافة إلى ما سمعناه في 19رمضان في مكة المكرمة من المشروعات المستقبلية لكم في توسيع الحرمين الشريفين، والإضافة إليهما، إلى عدد من المشروعات الكبيرة.

بعد تدخل رجل الدين المصري المقيم في قطر "يوسف القرضاوي" في الشأن السعودي عبر مطالبته بالسماح للنساء بقيادة السيارات استنكر الشيخ السعودي محمد بن سليمان البراك -أستاذ الدراسات العليا في جامعة أم القرى- دعوة القرضاوي مؤكداً أن علماء السعودية الموثوق بدينهم أجمعوا على التحريم.
ونقل موقع تواصل الالكتروني عن البراك قوله: "إن علماء بلاد الحرمين الموثوق بدينهم وعلمهم قد اتفقت كلمتهم على تحريم قيادة المرأة للسيارة؛ لعلمهم بما يترتب على قيادتها من المفاسد الدينية والأخلاقية والأمنية، وأن ذلك مرفوض شعبياً من النساء قبل الرجال، ولا يطالب به إلا فئام من المستغربين والمخدوعين الذين لا يشكّلون نسبة تُذكر من أبناء بلاد الحرمين".
و وجه البراك حديثه للقرضاوي قائلاً: «حريّ بك أيها الشيخ أن توجّه اهتمامك إلى قضايا الأمة الكبرى؛ فبلاد الحرمين ليست بحاجة إلى فتاوى مستوردة ممن لا يعرفون طبيعتها وخصوصية أهلها».

Ethical Oil: The Canadian Oil Industry and the Israel Connection

Canadian Oil Firms get extremely low in an attempt to boost their sales by striking a comparison between the "unethical" Saudi oil and the "environmentally disastrous" and "ethical" Canadian sand oil. Leaving the environmental issues aside, is the Canadian oil really "ethical?" Maggie Sager from Resisting Occupation argues against it.

Last month I discovered a piece on Feministing about a recent Canadian ad campaign for Ethical Oil. According to Ethical Oil’s website, the group:

Encourages people, businesses and governments to choose Ethical Oil from Canada, its oil sands and other liberal democracies. Unlike Conflict Oil from some of the world’s most politically oppressive and environmentally reckless regimes, Ethical Oil is the “Fair Trade” choice in oil. Countries that produce Ethical Oil protect the rights of women, workers, indigenous peoples and other minorities including gays and lesbians. Conflict Oil regimes, by contrast, oppress their citizens and operate in secret with no accountability to voters, the press or independent judiciaries.

The group’s now infamous ad, which can be seen here, speaks of the abuse women endure in Saudi Arabia, and paints Canada’s environmentally disastrous tar sands as the only alternative. But intelligent women aren’t falling for it.
As one blogger puts it:

“I am a feminist and I am an environmentalist. I don’t really appreciate being asked to compromise one to support the other….If Ethical Oil was truly interested in women’s rights, they’d be campaign for fuel efficiency standards. Instead they’re using the condition of Saudi women as a disgusting gateway to destroying the planet and encouraging an environmental disaster.”

The ad currently runs on Oprah’s OWN network. Upon discovering this, the exceptionally thorough environmentalist and writer Emma Pullman did some investigative work and found the following, which she then included in an open letter to Ms. Winfrey (the article also does an amazing job of unraveling the absurd logic Ethical Oil operates by):

According to Deep Climate, Ethical Oil isn't the low budget grassroots organization it purports to be. Its principals are some of the rising stars of the conservative movement in Canada, and one is a lawyer for tar sands firms.
Here's the back story: Ezra Levant turned "ethical oil" into a meme late last year. Almost overnight, pro-industry and government officials, keen to sell the filthy oil to a skeptical public, picked up the term and ran with it. After the Conservative election victory in May, Conservative government spokesperson (and former American Enterprise Institute intern) Alykhan Velshi took over at the helm of the ethicaloil.org blog. The blog is registered to Levant, who also has strong links to the Conservatives.
And, here's another thing that just doesn't add up for me. How is it that a former advisor to Environment Minister John Baird, and communications director for Immigration Minister Jason Kenney, would find himself taking an "unpaid" job as a blogger?Thanks to the folks over at Deep Climate, it makes a lot more sense. EthicalOil.org is connected to the obscure Ethical Oil Institute. Though there is scant reference to them online, according to their notice of incorporation, the institute was registered on March 9, 2011 to an Edmonton address, 12220 Stony Plain Road, Edmonton AB T5N 3Y4. That just so happens to be the address of the law firm McLennan Ross. McLennan Ross makes bathtubs full of money doing work for tar sands firms.The two members of the Ethical Oil Institute's board of directors are Ezra Levant and McLellan Ross partner Thomas Ross. Thomas Ross is one of ten lead partners in McLellan Ross’s OilSandsLaw.com initiative, a “slick new oilsands cross-selling strategy" and marketing campaign.

But it gets better. Pullman mentioned that Alykhan Velshi also contributes to the group. In fact, Ethical Oil openly states this, saying the site “began as a blog created by Alykhan Velshi.” More than simply an “intern for the American Enterprise Institute,” Velshi was also head of research at the Foundation for the Defense of Democracies, where he co-founded the Center for Law and Counterterrorism. He is an open supporter of Bush’s doctrine of pre-emptive war, does not believe the Geneva Conventions should apply to those captured in the War on Terror, and advocates the creation of a special National Security Court to try terrorism suspects.
More importantly, Velshi is an open and unabashed Zionist, working for Canadian Minister of Citizenship and Immigration Jason Kenney as his Director of Communications and Parliamentary Affairs. You might recall that Kenney made the news in 2009 as he was embroiled in a battle with Canadian Arab Federation president Khaled Mouammar in which Kenney and Velshi were able to successfully defund CAF after comments Mouammar made criticizing Kenney’s support for Operation Cast Lead. According to Velshi, Mouammar was “anti-Semetic.” See here for the full story.

And there's more. Writing for the Huffington Post, Velshi criticized the Saudi government’s attempt to get Ethical Oil’s ad off the air, explaining:

I have also alerted Foreign Minister John Baird and Dean Allison, Chairman of the House of Commons Standing Committee on Foreign Affairs and International Trade, about the incident in writing, calling on the Harper government and the parliamentary committee to investigate a foreign dictatorship trying to censor what Canadians can and cannot see on their televisions.While in a free, open, and democratic society, we can have vigorous disagreements about energy policy and the role Canada's oil sands should play in the energy supply mix, when a foreign dictatorship like Saudi Arabia tries to censor one side of that debate, we all need to stand as one in defending our rights as Canadians. That means that all of us -- including oil sands critics like Greenpeace -- need to condemn this brazen act of domestic political interference by a blood-soaked, conflict oil-fueled foreign dictatorship.

Wait, what? Need I remind you, this is the same man who played an instrumental role in successfully banning British PM and outspoken Israel critic George Galloway from entering Canada. From wiki:

Velshi told the media that the Canadian government would not reverse this decision, stating that Galloway had expressed sympathy for the Taliban cause in Afghanistan and describing him as an "infandous street-corner Cromwell who actually brags about giving 'financial support' to Hamas, a terrorist organisation banned in Canada.[33] The decision to ban Galloway was supported by the Canadian Jewish Congress, B'nai Brith Canada and the far-right Jewish Defence League of Canada, which took credit for initiating the action.[34] It was subsequently noted that Velshi had begun preparing media lines regarding Galloway several days before the ban was announced.[32]

The Canadian border police would not let Galloway into the country based on instructions from Velshi. Now tell me again, what did he say about free speech and debate?

I guess Velshi has no sense of irony. Either that, or he’s just a hypocrite. A neoconservative Zionist taking talking points from the Canadian Jewish Congress and B’nai Birth Canada, which act as in part as agents of Israel to insulate its “blood-soaked” apartheid regime from Western criticism has the gall to talk about other countries meddling in Canadian affairs. What exactly is his angle here?

In truth, Ethical Oil is guilty of myriad hasbara-esque techniques, among them greenwashing, pinkwashing, and the old familiar but-look-at-those-evil-Arabs-over-THERE excuse by comparison, except this time they're in the service of Canada rather than Israel. But these obfuscations don't work for Israel, and they shouldn't work for Canada either.

There is one piece of the puzzle missing here. Alstom won the first stage of the project that was worth $1.8 billion dollars in 2009. The Spanish company that won the contract for the second stage is a part of Al-Shula Alliance. So who owns Al-Shula Alliance? Knowing that might reveal the "real" reason behind not awarding the contract to Alstom.

The BDS Press Relase seems to be missing some important information.

Alstom has offices in Israel, Saudi Arabia, UAE, and Jordan and does a huge amount of work there. Normally energy related. It has made very lucrative deals with the Saudi Electricity Company (SEC) very recently.

Alstom transport has many projects in the region including Lebanon, Egypt, and Iraq.

It's also bidding on the new Gulf Railway Project that should be done by 2017 and cost $25 billion. It looks like that each country will build its own section of the GCC Railway and then they will be connected. The project has started by establishing companies in each country to handle the railway. Alstom has submitted bids for the various projects within each country, for instance here is the UAE one. And it won the bid for the Dubai Rail as well.

وتتضمن أعمال هذه المرحلة استكمال أعمال البنى العلوية، التي تشمل توريد وتركيب القضبان الحديدية وأنظمة الإشارات والاتصالات ونظام كهربة الخطوط، وأيضا توريد وتركيب 35 قطارا، كما تشمل تشغيل وصيانة المشروع خلال مدة العقد البالغة 12 عاما.

ويتكون التحالف الفائز من شركة "رينف" و"تالغو" و"أديف" و "أو أتش أل" وثماني شركات أخرى، بينما يتكون التحالف الفرنسي الخاسر من ألستوم وشركة النقل للسكك الحديد "أس أن سي أف".

منافسة شرسة
وكانت منافسة شرسة قد جرت بين الفرنسيين والإسبانيين لنيل الصفقة التي طرحت خلال زيارة قام بها رئيس الوزراء الفرنسي فرانسو فيون للمملكة في فبراير/ شباط الماضي.

وتعد إسبانيا من أكثر دول العالم خبرة في مجال مشروعات القطارات السريعة، حيث تتوفر على أطول شبكة سكك حديد في أوروبا.

وتبرز أهمية المشروع في أن موسم الحج يجتذب نحو مليوني ونصف المليون مسلم من كافة أنحاء العالم، حيث يقضون بالسعودية في المتوسط نحو أسبوعين متنقلين بين المدينتين المقدستين لأداء مناسك الحج والعمرة بمكة المكرمة وزيارة المسجد النبوي الشريف بالمدينة المنورة.

The BDS National Committee (BNC) has declared a long sought-after victory as Alstom lost the bid for the second phase of the Saudi Haramain Railway project, worth $10 billion US dollars, after pressure from the global Boycott, Divestment and Sanctions (BDS) campaign, including effective campaigning from the newly launched KARAMA, a European campaign to Keep Alstom Rail And Metro Away.
In 2008 the BNC, the largest Palestinian civil society coalition, with partners in Europe and Israel, launched the Derail Veolia and Alstom campaign, due to the two companies’ involvement in Israel’s illegal Jerusalem Light Rail (JLR) project, which explicitly aims to “Judaize Jerusalem,” according to official Israeli statements, by cementing Israel’s hold on the illegal colonial settlements built on occupied Palestinian land in and around Jerusalem. Since then, Veolia has lost more than $12B worth of contracts following boycott activism in Sweden, the UK, Ireland and elsewhere. Alstom, too, suffered substantial blows when the Swedish national pension fund AP7 excluded it from its investment portfolio, after having been excluded from the Dutch ASN Bank due to the company’s involvement in Israel’s occupation of Palestinian land, and has recently announced its intention to withdraw from the project.
The decision is in line with a decision adopted by consensus at the Arab Summit held in Khartoum in 2006 which condemned in the JLR project and called on “the two French companies [Alstom and Veolia] to immediately withdraw from the project,” and demanding that punitive measures be taken against them “if they don’t comply.” The Arab Summit also urged the French government to take the necessary measure in this respect to honor its obligations under international law. In March 2010, the UN’s Human Rights Council denounced Israel’s JLR project for being “in clear violation of international law and relevant United Nations resolutions.”
In commenting on the fierce competition between the Alstom-led consortium and its Spanish-led rival over the second phase of the lucrative Haramain Railway project, Emirati newspaper, Al-Ittihad, referred to “multiple factors” affecting the decision to award the contract, suggesting that political factors may have been taken into consideration.
The BNC and several partners have used private and public channels to urge the Saudi leadership to exclude Alstom from the second phase of this large project which will connect by rail Mecca with Medina after Alstom had won the much smaller contract for the first phase.
In 2009, BNC member organizations, Stop the Wall and the Civic Coalition to Defend Palestinians’ Rights in Jerusalem, have produced in-depth research about Alstom’s involvement in Israel’s illegal JLR project. Copies were sent to Saudi officials, prompting Palestinian leaders to address Saudi authorities urging them to exclude Alstom from their contracts.
Jamal Juma’a, Stop the Wall coordinator and BNC Secretariat member commented on the news saying: “This huge victory will be celebrated in the BDS campaign worldwide. We are hopeful that this will be the first of many decisions to kick Alstom out of the Arab world and beyond, sharply raising the price of its collusion in Israel’s violations of Palestinian rights.”

The Proposed Anti-terror Law in Saudi Arabia: Legalizing the Abrogation of Civil Liberties

On July 22^nd, 2011 Amnesty International published a leaked copy of the proposed Saudi Arabian Penal Law for Terrorism Crimes and Financing of Terrorism[i]. The proposed anti-terror law was being reviewed by the Security Committee of the Consultative Council (Mjles Alshoura) before being presented to the Council and eventually to the Ministers Council and the King. The leaked copy obtained by Amnesty International is in its final stages. It was already reviewed by the Security Committee, which provided very minor changes, and the Committee of Experts in the Ministers’ Council has responded to these proposed changes and disregarded them[ii]. Right after the proposed law was leak, Amnesty International, Human Rights Watch, and local activists provided general critique of the law and encouraged the government not to adopt it. The official National Society of Human Rights in Saudi responded as well; however, their version of criticism was watered down and lacked any details.[iii]

In response to this leaked document, the Saudi government decided to block the access to Amnesty International’s website in Saudi Arabia. Then it lifted the ban after a shaming campaign by Saudi and International activists. The only official response came from the Saudi Embassy in London, where the headquarters of Amnesty International are located.[iv] The Ambassador’s letter focused on few main issues: first, the Ambassador pointed out Amnesty International’s unprofessionalism by not contacting him first and soliciting his response before publishing the leaked copy of the proposed anti-terror law. He stated that the measures taken by Saudi Arabia to combat terrorism were praised by the United Nations. He, however, did not substantiate these praises. Saudi Arabia’s history and traditions should provide the best guarantee that this proposed anti-terror law would not be abused, he stated. Finally, he made a great emphasis on the nature of the crimes being dealt with here and the importance of national security.

On July 21^st, 2011, a day before the document was leaked by Amnesty International, a Saudi legal researcher and the president of a legal awareness group posted an article demanding that Saudi Arabia issues a temporary anti-terror law similar to the ones issued by the United States (the Patriot Act), England, Morocco, Qatar, Oman, and Iraq.[v] This response might be logical taking in consideration how the issue of the Saudi Prisoners of Conscience became the subject of public debate recently. However, an additional set of laws to combat terrorism in not necessary regardless whether it is permanent or temporary. The current Law of Criminal Procedure can provide enough guarantees that ensure a speedy, fair, and inexpensive trial. Unlike the proposed anti-terror law, it only gives limited discretion to the Ministry of Interior, which restricts its ability to abuse it.

The Saudi Criminal Procedure LCP

In 2002 Saudi Arabia published its first Law of Criminal Procedure (LCP)[vi].

This law contains 225 articles laying out the process for the initiation of criminal action; rules of collecting and preserving evidence; conditions of arrest and pretrial detention, including bail; and the jurisdiction of courts and their proceedings … These new laws gave Saudi citizens and residents a clearer definition of their rights in detention and at trial and laid out the procedures the investigators and courts must follow. For the first time, defendants had the right to legal counsel during investigation as well as at trial (Law of Criminal Procedure, Article 4).

The LCP provided certain guarantees and rights that were never codified in any Saudi legal system. It provided the right to be represented by a lawyer through out investigations, charging, and trials.[vii] The LCP provided certain guarantees against prolonged detention as well. Article 33 and Article 34 state that a person cannot be held for over 24 hours without a written order and must be seen by an investigator and charged within this 24-hour period. The detainee has the right to immediate communication with whoever he or she chooses to inform of his detention and charges. More importantly, a person cannot be held incommunicado and must be able to inform others of his arrest.[viii] Similarly, the LCP provided for a proper searching procedure where the citizen’s privacy is respected; the search must be done during the daytime; the person must be present when his home is being searched; and finally a detailed warrant supported by specific information and probable cause is required.[ix] Private conversations are highly protected in the articles of the LCP.[x] Monitoring people’s communications and wiretapping must be supported by probable cause and its warrant is temporary one that must be renewed every 10 days. During the investigation, the accused must be informed of the charge during the first meeting with the investigators and no form of coercion should be used.[xi] The fact that the authorities need to investigate and charge within a 24-hour period or release the detainee was of a quite importance since it was repeated in two separate articles in two different sections of the LCP.[xii] This period could be extended to 6 months, however, only after the initiation of investigation and for particularized reasons.[xiii] Finally, the LCP gives the Minister of Interior the discretion to define the capital crimes that require arrest; however, the default arrest period is only 5 days.[xiv]

The LCP is far from being perfect. Some major progress and development needs to be achieved in order for the LCP to meet proper international standards. The LCP could only be enhanced through proper implementation. However, its shortcomings and deficiencies did not go unnoticed, they have been highlighted by international human rights organization as well as local human rights lawyers and activists. Human Rights Watch in its 2008 report based its criticism on comparing the LCP with the regional and universal treaties.[xv] It focused its criticism on the lack of codification of crimes. Judges and investigators are given the discretion to interpret the Sharia (Islamic Jurisprudence) texts and define the crimes, their elements, and the punishment. With the lack of codification, prompt charging is not possible since the investigator will only charge after the completion of the investigation and not within the required 24-hour period.

The Saudi lawyers and activists based their analysis and criticism of the LCP on Sharia law (Islamic Jurisprudence), which is a very strategic move in Saudi Arabia. Using this tactic activist avoid being called Westernizes, which might create a barrier inhibiting the public from accepting the activists’ argument. Waleed Al-Majid, a Saudi writer and researcher, raised two main points. First, a Sharia principle requires that nobody could be punished without a text, which mirrors the universal principle of “no punishment without law.”[xvi] His second major point was the fact that this LCP has not been applied in Saudi Arabia despite the fact that it has been in effect since 2002. The lack of implementation hinders any possible improvement through practice. Since it was not implemented, challenging its violation in court has not been possible either.

Human rights activist and Saudi lawyer Abdulrahman Al-Lahim pointed out that the LCP lacks two main principles.[xvii] The first one is what is known as the fruit of the poisonous tree doctrine. The doctrine states that a piece of evidence is invalid if it is the result of an improper procedure; meaning that if the evidence is obtained in violation of the LCP, it should be excluded from the trial. However, the LCP does not provide for this critical measure. The second doctrine is the presumption of innocence. The LCP places the burden of proof on the accused not the investigator. Al-Lahim wants to call the LCP the “law of the honorable,” meaning that the accused should be treated with honor and respect until proven otherwise by a final verdict from the court. The current state of the LCP provides otherwise. The accused is presumed guilty until proved otherwise and he bares the burden of proving his innocence.

The strength, as well as the weakness, of the LCP appears when it is applied during challenging times. Starting from 2003, Saudi Arabia was the target of various terrorist attacks and was forced to deal with a novel problem. Instead of putting the LCP to test and strengthening it while implementing it, the Saudi government decided to take a different route.

The Draft Penal Law of Terrorism Crimes and Financing Terrorism

The committee listed numerous Saudi and international bodies of law as basis and justifications for the proposed anti-terror law; the long list included the LCP, a great number of international and regional treaties, different anti-terror laws in the area, and the United Nations Security Council’s Resolution 1373 of 2001 which dictates that States shall bring every person participating in the commission of a terrorist act in any form or shape to justice and establish such terrorist acts as crimes in domestic law.[xviii][xix] Despite the fact that the proposed anti-terror law is a late response to the Security Council’s Resolution, it violates numerous international treaties and basic human rights principles. However, the reference point in this section will be the LCP adopted by the Saudi government in 2002 and not these international norms. An efficient LCP would eliminate the need to enact an anti-terror procedural law like the one reviewed by the Consultative Council.

What the proposed anti-terror law does is four major things. First, it gives the Ministry of Interior and the Minister himself and unprecedented level of authority and discretion. Second, it defines terrorist crimes over-broadly and vaguely. Third, it lacks the basic measures of due process and fair trial. Finally, and more importantly, it chills and officially bans, free expression and the freedom of assembly.

The Ministry of Interior has maintained a great level of authority for a long time. With the lack of any rules of civil procedure and codification of crimes, this power could not have been the subject of any checks and balances. However, the adoption of the LCP limited its authority and subjected it to certain measures. The LCP, however, was never implemented and there were no adopted measures in the LCP itself to ensure its strict application. Despite this major flaw, the LCP could have been enforced through the courts and improved over time. Unfortunately, this opportunity could be lost. The proposed anti-terror law gives the Interior Minister excessive powers under the cover of law; a power that is not subjected to any judicial oversight or any forms of checks and balances. 9 articles out of 72 give the Interior minister vast authority when it comes to dealing with terrorist crimes. In addition to arresting, with or without warrant, for any suspicious activity, and conducting the investigation or halting it (even during trial), the Interior Minister can “take any measure to protect the country from any terrorist danger.”[xx] Once the rights guaranteed by this proposed anti-terror law are violated, the person can only appeal to the Interior Minister, and not the court, to seek relief.[xxi] This authority is not subject to any judicial oversight, quite the opposite; the Minister could halt any trial if he determines that the accused is innocent.

The fact that the Interior Ministry was granted an unprecedented authority is not surprising. In drafting this law, various governmental agencies’ participation was solicited. It is logical for the Interior Ministry to propose a law that would entitle it to act without any oversight, and increase its authority while restricting civil liberties using the national security as an excuse. The fact that this input was adopted in the final version of the proposed anti-terror law is surprising, however. When this authority is coupled the vague and overbroad definition of terrorist crimes, this authority could be proven dangerous.

The first article of the proposed anti-terror law could be the most article susceptible to abuse. It provides a vague and overbroad definition of terrorist crimes and incriminate a wide range of activities. Article 1 of the proposed anti-terror law defines a terrorist crime as “any action or speech, individually or collectively, that violates the general order of the country, endanger the society’s security, endanger national unity, halt the Basic Law or any of its articles, harm the reputation of the country or its position, damage any of the country’s facilities or its natural resources, or threaten to do any of the above mentioned acts.”[xxii] Under this broad definition falls “anything that leads to establishing the intellectual or religious foundation that justify these crimes, promoting these crimes, inciting them, or publicizing these crimes or the foundations that lead to them.”[xxiii] A similar broad definition is provided for financing any terrorist activity.

This vast definition falls under both definitions of overbroadness and vagueness. An overbroad law is a law that prohibits and covers substantially more than what is necessary to achieve the goal of the law. A piece of law is considered vague when a person of moderate intelligence reads it and does not understand what is being prohibited. This proposed anti-terror law goes against the current movement to codify crimes in Saudi Arabia to limit the discretion of the Interior Ministry and the judges. It defines the crimes in general terms and leaves the door open to the judges and the Interior Ministry to identify more crimes that fall under the vast umbrella of “terrorist crimes.”

In addition to terrorist activities, the law encompasses some major forms of freedom of speech. It prohibits any criticism of the government or the country because it might threaten the society’s security, the country’s unity, its general order, or harm its reputation or position. The vagueness and fluidity of these terms is overwhelming. What does all these previously mentioned terms mean? For instance, a Saudi Sunni clerk gave a Friday sermon attacking the Shia in general few months back, does that threaten the national unity? Will he be punished under this proposed anti-terror law? Other parts of the proposed anti-terror law have similar effect on the freedom of assembly as well. Punishment and these sections will be discussed in a later section.

In addition to the vast authority given by the proposed anti-terror law and the vague and broad definition of terrorist crimes, the law violates the basic principles of due process and fair trial.[xxiv] The LCP provided that a person cannot be held in detention for over a 24-hour (or 48-hour) period without investigation. However, the proposed anti-terror law extends the investigation period to over 6 months, subject to extension. It gives the authority to detain for a period over a year, subject to extension, without justification, charge, or trial. A detainee can be held incommunicado for over 120 days, subject to extension. The LCP on the other hand states that a detainee has an immediate right to communicate with anybody, including a lawyer. The proposed anti-terror law’s denial of a lawyer’s assistance extends beyond the investigation stage and to the trial period. The Interior Minister, or whomever he delegates, have the right to arrest and detain any person immediately for a period of 3 months, subject to extension, without providing any justification.

What this proposed anti-terror law does is destroy all the fair trial guarantees provided by the not-yet-applied LCP. It gives the detaining authority, the Interior Ministry, the power to disregard any measures provided by the LCP and justifying that by the nature of this type of crimes. As discussed earlier, a vast amount of crimes could fall under this category giving the authorities a level of discretion that violates the basic aspect of due process.

Finally, the proposed anti-terror law curtails freedom of assembly, limits freedom of expression, and provides excessive punishments for vague and overbroad crimes. The definition of terrorist crimes in itself entails serious limitations of the freedom of expression and assembly by encompassing a wide range of speech and activity under it. In addition to the crimes listed in the definition, the punishment section of the proposed anti-terror law list additional crimes that are punishable by this proposed law.[xxv] Claiming that the King or the Crown Prince are non-believers, or questioning their integrity or honesty is punishable by a minimum of 10 years. A minimum punishment of 5 years is imposed on any person who says or prints anything that might endanger the general security or shake the stability of the country, or incite anybody to do so. Establishing, leading, organizing or administrating any “terrorist” entity is punishable by a minimum of 25 years. Being a member is punishable by a minimum of 10 years, while recruiting or financing the entity is punishable by a minimum of 15 years of imprisonment. A public appraisal of any “terrorist act” is punishable by a minimum of 5 years of imprisonment. The minimum punishment for holding a meeting to plan a “terrorist attack” is 10 years.

Protesting for any reason is prohibited in Saudi Arabia. However, there was never a clear law against it. The proposed anti-terror law changes that. Article 47 of the proposed anti-terror law makes protesting illegal to protest for any reason, whether related to a terrorist crime or not. It states “a minimum of 3 years of imprisonment should be imposed on anybody who organizes a protest, participates in organizing it, aids in its preparation, incites or invites others to participate.” Attending a protest is punishable by a minimum of 1 year of imprisonment, while the punishment increases to 7 if the person carries any sign or picture that threatens the stability or unity of the country. The proposed anti-terror law does not specify whether these punishments are imposed only when the protest are related to terrorist crimes or not. It could be applied to any protest, regardless of its nature.

There are three observations regarding these punishments. First, they limit the judge’s discretion because unlike other prison terms, the punishment specifies the minimum number of years of imprisonment not the maximum. Second, when the general, fluid, and broad language mentioned in the punishment articles are coupled with the vague and overbroad definition of “terrorist crimes,” the combination is quite dangerous and prone to abuse. Finally, the ban of protesting is mentioned specifically without any reference to any terrorist activity. It seems that this article was mentioned as a specific response to the uprising in the Arab World.

This proposed anti-terror law creates a disastrous combination: an unprecedented vast authority of the Interior Ministry, a vague and overbroad definition of “terrorist crimes,” the stripping of basic principles of due process and fair trial; an express ban of protesting for any reason; and the chilling of the freedom of expression and assembly in many forms. With the lack of a constitutional court to declare that the law invalid, the law cannot be attacked as unjust or in violation of the Saudi constitution or Basic Law.

The Security Council’s Resolution called on all nations to bring persons accused of terrorist crimes to justice. This proposed anti-terror law does anything but that. It might be a response to the raising issue of political prisoners in Saudi or a response to the recent Arab Spring. However, it is a response in the opposite direction. Instead of strengthening civil liberties to stabilize the country and face criticisms, this proposed anti-terror law does the opposite. It strips the citizens of some of their basic civil liberties: their basic freedom, freedom of speech, freedom of assembly, and it legitimizes policing power. Passing a law banning protesting makes the ban legal but not just. Using national security as an excuse to give the authorities the discretion to strip the detainees of their rights of due process and fair trial might seem logical, but it can never be fair. Relying on the goodness of the hearts of the people applying the abuse-susceptible law, as suggested by the Ambassador’s letter, is both unrealistic and absurd. Using the threat of terrorism as an opportunity to curtail the citizens’ freedom can only breed more terrorism. This time it might be justified.

الزوجة بين المملوكة والدار المستأجرة

الدكتورة سهيلة زين العابدين تثير نقطتين مهمتين في هذه المقالة. اولا: لماذا نعطي الآمة الآربعة درجة من القدسية تمنعنا عن انتقاد او مسائلة اي كتبهم. ثانيآ: يبدو ان النظرة الدونية للمرأة لها تاريخ طويل في كتب الدين. هذا يعتبر نتيجة منطقية لاحتكار الرجال علم الفقه (حتى الفقه النسائي) على مدى طويل.

عندما تقرأ في كتب الفقه عن نظام الزواج في الإسلام وأحكامه وحقوق الزوجين تجد العجب العُجاب، فقد جعل الفقهاء الزوجة في حال صحتها وعافيتها أمة مملوكة لزوجها بعقد النكاح، وفي حال مرضها دارا مستأجرة لعدم إلزامه بعلاجها، فقد أورد ابن قدامة في كتابه المغني مقولة للإمام الزهري «لا يقتل الرجل في امرأته لأنّه ملكها بعقد النكاح» وهذا مخالف لقوله عليه الصلاة والسلام ( من قتل عبده قتلناه، ومن جدعه جدعناه) وتقرأ لابن القيم في إعلام الموقعين مقولته « إنّ السيد قاهر لمملوكه، حاكم عليه، مالك له، والزوج قاهر لزوجته، حاكم عليها، وهى تحت سلطانه وحكمه شبه الأسير»، وتقرأ لابن علي الجوزي في أحكام النساء:» وينبغي للمرأة أن تعرف أنّها كالمملوك للزوج ..وينبغي لها الصبر على أذاه كما يصبر المملوك» إضافة إلى كل المرويات الضعيفة المنسوبة للرسول صلى الله عليه وسلم عن طاعة الزوج، كأحاديث « لو أمرتُ أحدًا أن يسجد لأحد لأمرتُ المرأة ان تسجد لزوجها»، وحديث «لو سال من منخراه ( أي فتحتي أنف الزوج) دمًا أو قيحًا، أو صديدًا ولحسته ما وفته حقه لما فضله الله عليها، بل هناك مرويات ضعيفة سندًا ومتنًا يستشهد بها ابن قدامة في كتابه المغني تعطي للزوج حق منع زوجته من عيادة والدها المريض، بل حتى من حضور جنازته، هذا الأب المكلف بعلاجها في مرضها طبقًا لهذا الحكم الفقهي الظالم، فقد روى ابن بطة عن أنس أنَّ رجلاً سافر ومنع زوجته الخروج، فمرض أبوها، فاستأذنت رسول الله عليه الصلاة والسلام في عيادة أبيها، فقال لها عليه الصلاة والسلام: «اتق الله ولا تخالفي زوجك»، فمات أبوها فاستأذنت رسول الله صلى الله عليه وسلم في حضور جنازته، فقال لها:» اتق الله ولا تخالفي زوجك»، فأوحى الله إلى النبي صلى الله عليه وسلم: « إنِّي غفرتُ لها بطاعة زوجها».فهذا الحديث ضعيف من حيث المتن والاسناد، ومن دلائل ضعف المتن، مخالفتها لأمر زوجها مرتين بخروجها لسؤاله عليه الصلاة والسلام، ولم ينهها عن ذلك، ولو كان الحديث صحيحًا لمنعها، كما أنّه يناقض الأمر الإلهي ببر الوالدين الذي قرنه بطاعته، إضافة إلى انتقاد ابن قدامة له، فلوكان صحيحًا لما انتقده، يقول ابن قدامة: « ولا يجوز لها الخروج إلاَّ بإذنه، ولكن لا ينبغي للزوج منعها من عيادة والديها وزيارتهما لأنَّ في ذلك قطيعة لهما وحملاً لزوجته على مخالفته، وقد أمر الله تعالى بالمعاشرة بالمعروف، وليس هذا من المعاشرة بالمعروف.»[ 8130] والحديث ضعيف الإسناد، يقول الذهبي في سير أعلام النبلاء: لابن بطة مع فضله أوهام وغلط»، وقال عنه عبيد الله الأزهري « ضعيف، ولا أخرج عنه في الصحيح شيئًا»، وقال حمزة بن محمد بن طاهر الدقاق لم يسمع ابن بطة الغريب من بن عزيز، وادعى سماعه، وقال الخطيب وروى ابن بطة كتب ابن قتيبة عن ابن أبي مريم الدينوري ولا يعرف ابن أبي مريم.ولكن في حالة مرضها جعلوها دارًا مستأجرة لعدم إلزام الزوج بعلاجها، حيث نظروا للعلاقة الزوجية علاقة جنسية محضة، أي جعلوا الزوجة يُنفق عليها مقابل الاستمتاع بها فحصروا إلزام نفقة الزوج عليها في نطاق متعته الجنسية، بإصدارهم حكمًا فقهيًا بُني على اجتهادات شخصية غير مبنية على آيات قرآنية وأحاديث نبوية، يقول فضيلة الدكتور وهبة الزحيلي:» قرر فقهاء المذاهب الأربعة أنَّ الزوج لا يجب عليه أجور التداوي للمرأة المريضة من أجرة طبيب وحاجم وفاصد ،وثمن دواء، وإنَّما تكون النفقة في مالها إن كان لها مال، وإن لم يكن لها مال وجبت النفقة على من تلزمه نفقتها لأنّ التداوي لحفظ أصل الجسم، فلا يجب على مستحق المنفعة كعمارة الدار المستأجرة تجب على المالك لا على المستأجر» [ الفقه الإسلامي وأدلته:7794] ، ويقول ابن قدامة « الحنبلي» في المغني:» ولا يجب عليه - أي الزوج - شراء الأدوية ولا أجرة الطبيب لأنّه يراد لإصلاح الجسم ، فلا يلزمه، كما لا يلزم المستأجر بناء ما يقع من الدار وحفظ أصولها، وكذلك أجرة الحجام والفاصد.» [ابن قدامة : المغني ،كتاب النفقات ، فصل رقم « 6460» ويقول فقيه الحنابلة في مصر البَهوتي ـ في كتاب النفقات في كشاف القناع: «ولا يجب عليه -أي الزوج -الأدوية وأُجرة الطبيب والحجَّام والفاصد والكحال، لأنَّ ذلك يُراد لإصلاح الجسم، كما لا يُلزم المستأجر بناء ما يقع من الدار)وقد بيّن الإمام الشافعي سبب تقريرهم عدم وجوب علاج الزوجة بقوله «وإن كانت النفقة للحبس، فهي محبوسة، وإن كانت للجِماع، فالمريض والغائب لا يُجامعان في حالهما تلك، فأُسقط لذلك النفقة[ كتاب الأم : كتاب النفقات 6/ 342، 343]هذا ومن خلال هذا المنظور الجنسي للزواج أباح بعضهم زواج المسيار وأمثاله.وأتساءل: مادام ليس على الزوج علاج زوجه، لماذا يعطى حق منعها من التعلم والعمل؟ إذ كيف تُعالج نفسها إن مرضت، إن كان أبوها متوفىً، أو فقيرًا، وهي لا تملك مالًا للعلاج، هل تُترك بمرضها إلى أن تموت؟ومادامت الزوجة كالدار المستأجرة لماذا يرثها ؟ هل يرث المستأجر الدار المستأجر لها؟وأين هي مسؤولية قوامة الزوج المشروطة بالإنفاق، فالخالق لم يربط مسؤولية الإنفاق بعافية الزوجة، ويوقفها بمرضها؟ وأين هذا الحكم من اتفاق الفقهاء على أنَّ المطلقة طلاقاً رجعياً تستحق النفقة والسكنى طوال عدتها؟ وكيف يناقض الفقهاء أنفسهم، فيضعون مرض الزوجة أحد مبررات التعدد؟

إنّ كل تلك الأحكام مخالفة لعدل الله ،ومخالفة تمامًا لقوله تعالى:(وَمِنْ آَيَاتِهِ أَنْ خَلَقَ لَكُمْ مِنْ أَنْفُسِكُمْ أَزْوَاجًا لِتَسْكُنُوا إِلَيْهَا وَجَعَلَ بَيْنَكُمْ مَوَدَّةً وَرَحْمَةً )( هنّ لباسٌ لكم وأنتم لباسٌ لهنّ)( وعاشروهن بالمعروف) ،( ولهن مثل الذي عليهن بالمعروف)، وقوله عليه الصلاة والسلام ( خياركم خياركم لنسائه، وأنا خياركم لنسائه).

من الذي يستطيع أن يعلق الجرس؟!

كنت دائما أتسائل لماذا لا يوجد مفتيه سعوديه؟ فقيهه سعوديه؟ سألت مره أمام مسجدنا بعض خطبة جمعة طويله عن دور المرأه في المجتمع و الدعوه لتغرييب المرأة السعودية المسلمه عن عالمة الحديث التي تتلمذ على أيديهم جهابذة علماء الحديث. قال لي أن عددهم محدود و أن الرجال سباق في مجال العلم الشرعي تاريخيا. هل مشعل السديري أعلم من أمام مسجدنا؟ لماذا تغيب هذه المعلومات عن العامة؟ بسبب غياب هذا التاريخ، لا أعتقد أن هناك اليوم بنت سعودية تطمح أن تكون المفتيه العامه للمملكة!

تخيلوا مجرد تخيل لو أن هناك امرأة عالمة أرادت أن تضع لها كرسيا في أحد المساجد لتدرس الناس علنا وتفقههم في علوم دينهم ودنياهم، ماذا يحدث لها من (بلاوي)؟!

الذي دعاني إلى هذا التفكير (شبه المنحرف) هو الصداع الذي أخذ يضرب على (نافوخي) بعد أن تعبت من قراءات بعض الكتب القديمة التي تذكر فضل بعض النساء على الكثير من الرجال في مراحل متعددة من التاريخ، ولا أريد أن أسرد كل ما قرأته، لأنني لا أستطيع ذلك، إما لكثرته أو لبعض المحاذير.

ولكنني أقتطع لكم بعض الفقرات، وعليكم أنتم أن تجيزوها إذا أردتم، أو أن تستسخفوني إذا شئتم، ولكم كذلك كامل الحق أن تقولوا لي متعجبين: هل هذا هو وقته؟! امش (جنب الحيط أحسنلك وخليك من الحكي الفاضي)، ولكن ومع ذلك سوف أحكي وأمري لله.

قال (عروة بن الزبير): ما رأيت أحدا أعلم بالقرآن ولا بفريضة، ولا بحلال، ولا بحرام، ولا بفقه، ولا بطب، ولا بشعر، ولا بحديث العرب، ولا بنسب من عائشة رضي الله عنها.

وقال (أبو رافع الصائغ) في (التمهيد) كنت إذا ذكرت امرأة فقيهة بالمدينة ذكرت (زينب بنت أبي سلمة) و(عائشة بنت يوسف الباعونية) نالت من العلوم حظا وافرا، وأجيزت بالإفتاء والتدريس، وألفت كتبا عدة منها (الفتح الحنفي).

وأورد (تقي الدين الفاسي) في كتابه (العقد الثمين) تراجم لأكثر من (250) امرأة من المكيات اللاتي أجيز لهن التحدث والإفتاء والتدريس، وأخذ القرآن الكريم عنهن، والحديث والفقه. وكانت النساء العالمات إذا جئن إلى المدينة المنورة يلقاهن طلاب العلم والعلماء ويستفيدون منهن. ويذكر العالم (ابن رشيد الفهري) في سرده لأحداث رحلته إلى المدينة أنه التقى بأم الخير (فاطمة بنت إبراهيم البطحائي) في مسجد رسول الله، صلى الله عليه وسلم، وقرأ عليها، وأعطته إجازة خطية بجميع مروياته.

ولا ننسى أن (ابن عساكر) وهو يعتبر حافظ الأمة كان من شيوخه وأساتذته بضع وثمانون من النساء. فهل سمع الناس في عصر من العصور، وأمة من الأمم، أن عالما واحدا تلقى علما واحدا عن بضع وثمانين امرأة؟

وأورد (ابن دهمان) أن هناك عالمات مسلمات كن يدرسن الرجال ومنهن (بنت المرتضى)، و(زينب المقدسية) التي كانت تدرس في جامع ابن أمية، وكان بين طلابها (ابن بطوطة). وقد وصف الذهبي أن الطلاب من الجنسين كانوا يتزاحمون عليها. وفي الجامع عينه كانت تدرس (أم الدرداء الصغرى) وكان لها حلقة يحضرها الخليفة أمير المؤمنين (عبد الملك بن مروان) وفي مسجد بغداد كانت هناك (الدينورية) وكان من طلبتها ابن الجوزي والتعاويذي. (ونفيسة بنت الحسن) كان لها حلقة في مصر، وكان يحضرها (الإمام الشافعي).

تصوروا (الإمام الشافعي) بجلالة قدره يستمع ويتعلم من امرأة (!!)، فهل هناك شيخ من مشايخ اليوم يقبل أن يتعلم من امرأة؟!

وبعد هذا (اللت والعجن) من قِبلي يحق لي أن أتساءل بمرارة: هل المرأة في وقتنا الحاضر تقدمت أم تأخرت؟!

أما سؤالي الأخير الذي لا أريد إجابة عليه هو: من الذي يستطيع أن يعلق الجرس في رقبة القط؟!

القيادة .. وقيادة النساء

قال خادم الحرمين الشريفين، الملك عبدالله بن عبدالعزيز حفظه الله عندما سألته بعض المشاركات في الحوار الوطني الثالث عام 2003 خلال مقابلتهن وسلامهن عليه، عن متى سوف يُسمح للنساء بقيادة السيارة فقال لهن : "الصبر الصبر، قريباً إن شاء الله". وفي مقابلة لشبكة تلفزيون "إيه بي سي" الأمريكية في 15/10/2005 يقول في رده حول نفس السؤال: "أمي امرأة وأختي امرأة، وابنتي امرأة، وزوجتي امرأة، وسيأتي اليوم الذي ستتمكن فيه النساء من قيادة السيارة، زد على ذلك أنه في بعض مناطق السعودية في الصحارى أو المناطق الزراعية تجدون نساء يقدن سيارات، إن المسألة تتطلب الصبر.. ومع الوقت أعتقد أن هذا الأمر سيصبح ممكنا". وفي حديث له مع جريدة البايس الإسبانية في 18/6/2007 في سؤال حول المرأة وقيادتها السيارة قال حفظه الله: "لقد أثبتت المرأة السعودية - على مر السنين - قدرة علمية ومهنية واجتماعية وكفاءة عالية تضاهي مثيلاتها في العالم، كما أننا لا نستطيع أن نتحدث عن التطور الشامل الذي تشهده بلادنا بمعزل عن الدور الهام للمرأة السعودية في هذه التنمية، لذلك نحن حريصون على تعزيز هذا الدور بالعمل على تهيئة الظروف والبيئة الملائمة التي تحفز المرأة السعودية وتكفل لها العمل في إطار عاداتنا وتقاليدنا الاجتماعية وشريعتنا الإسلامية"

وعندما سئل سمو ولي العهد الأمير سلطان بن عبدالعزيز ما رأيه في منع المرأة السعودية من قيادة السيارة في (25/12/2005)؟ قال: "إنه إذا كان الأب أو الأخ أو الزوج السعودي يسمح لزوجته أو ابنته أو أخته بقيادة السيارة، فإن الدولة ليس لديها مانع في ذلك، مشيرا إلى أن هذا الموضوع اجتماعي وليس قرار دولة".

وعندما سئل سمو وزير الخارجية الأمير سعود الفيصل خلال مرافقته لخادم الحرمين الشريفين إلى بريطانيا، في مقابلة مع القناة الرابعة البريطانية (1/11/2007) عن قيادة المرأة للسيارة في السعودية أجاب: "عن نفسي.. أعتقد أنهن ينبغي أن يقدن (السيارات)، لكننا لسنا من يتخذ قرارا في هذا الشأن، يجب أن يكون قرار الأسر".

وبناء على هذه التعليقات الإيجابية والتي تتناسب مع موقف المملكة تجاه القضايا الحيوية التي تتعلق باقتصاد البلاد وبتطورها الاجتماعي والتزاماً منها باتفاقياتها الدولية وعلى رأسها اتفاقية السيداو (مكافحة جميع أشكال التمييز ضد المرأة) التي وقعتها وصادقت عليها السعودية عام 2000، ونظراً لما يترتب على أن تكون السعودية هي البلد الوحيد في العالم الذي يمنع النساء من قيادة السيارة مفضلةً عليه استقدام مليون سائق من بلاد أجنبية، سواء من هدر اقتصادي أو مشكلات اجتماعية أو أمنية أو تناقض فكري، ما يمكن تفصيله في وقت لاحق، فإن الرسالة التي وصلت النساء والعائلات هي أن العائلة التي ترى أنها يمكنها أن تسمح أو تقبل أن تقود نساؤها سياراتها وتحمل رخصاً معترفا بها محلياً بحيث لا تخالف قانون المرور، الذي لا يشترط الذكورة للحصول على الرخصة، فإنه يمكنها تولي زمام المقعد الأمامي.

ما يتبقى هو حاجة الجهات التنفيذية والخدمات المساعدة لأنْ ترقى إلى مستوى رغبة ورؤية القيادة السياسية الحكيمة، وتحيل تمنياتها إلى واقع، وسوف أفصل في هذا الأمر في مقال قادم إن شاء الله.

Flotilla activists still have much to learn about Gaza siege

"They didn't reach Gaza. They still have something to learn about the siege. But in their countries and their societies, they expand the essence of democracy, as continual civic participation that is motivated by an appetite for freedom and is not satisfied with voting only. We can only hope that the ripples from there will reach the country between the river and the sea."

The glittering lights of the magical Greek island of Kastelorizo, from which we had distanced ourselves only two to three hours earlier, once again came into sight on Saturday night, July 16. For the 12 passengers on board the Karama - including crew and journalists whose presence the coast guard had permitted - the boat was too small. The French delegation in the flotilla had bought a pleasure yacht, called it "Dignite" (karame, dignity ) and turned it into a floating situation room, a sauna full of stale cigarette smoke, with eight sleeping berths without water for showering, a deafening motor and poisonous diesel fumes.

Another four "clandestine" passengers were supposed to join those officially registered, and to participate in the group experience of becoming adjusted to discomfort as an act of political rebellion. Three had jumped into the boat the moment it moved away from the pier, without the coast guard noticing. Or to be more exact - pretending not to notice. The only one remaining was the sociologist, the Greek professor Vangelis Pissias, who for mysterious reasons didn't get his new passport on time, and had only a passport that had expired four days earlier.

The adventure became the goal

We returned after midnight in order to pick him up, aboard a fishing boat with a sympathetic fisherman who knew very well under which cliff on the tiny island to hide in order to evade the radar. It wasn't easy to find them - without a flashlight, without a phone connection. Karama slowly and cautiously made its way through the dark, quiet water and turned around, a bit lost, until someone said in a loud whisper: "Here they are." A full moon painted the outlines of the boat with a weak stripe.

"Hasamba" [a reference to an Israeli children's adventure series], said Pissias' good friend, Dror Feiler, who almost wept when the man with the white beard walked between the shaking boat and rocking yacht. Feiler is no longer an Israeli citizen. But culture and childhood memories need no stamp of approval from the Interior Ministry. We sang the Israeli song "A fishing boat is sailing, with two masts," and together forgot several of the rhymes, when the Karama, which had begun its journey on June 25 from Corsica, sailed (with us ) from a Cretan port on July 12. The other passengers must have found associations from their own culture in order to express some self-mockery and to put into words the contradiction of which everyone was aware: The means (a sea voyage to protest the siege of Gaza ) had turned into the end itself. The adventure had become the goal. And this boat would sail!

The island of Kastelorizo is about two miles from Turkey's territorial waters. In 1942 and 1943, the fear of German attacks caused the flight of its inhabitants, some of whom found refuge in Gaza for several years. The idea was that there, the sympathy for Gaza and the proximity to Turkey would neutralize the tricks of Greek bureaucracy, which proved so effective in preventing the sailing of the other eight boats. That's why it was worthwhile to invest 20 hours of sailing northeast, on a stormy sea, and to enable Pissias to negotiate with the coast guard there.

The official destination was Alexandria. The idea was to refuel there and then to continue to Gaza. That plan was abandoned out of a desire not to become involved in the sensitive political entanglements in Egypt. The 10 activists on the Karama have worked in the past year in their respective countries (France, Sweden, Greece and Canada ) to raise money from tens of thousands of people at informative meetings about the siege of Gaza, to convince trade unions to join, to interest writers and actors, to look for suitable seagoing vessels.

In the past week, they unwillingly turned into a symbol of the flotilla and into the representatives of all the hundreds of participants who didn't sail. These hundreds, including young people who are still studying in university or looking for work, paid for the cost of the flights and the stay out of their own pockets. These hundreds were united in their frank and natural revulsion at the existence of a huge prison like the Gaza Strip. The thought that an open sea could become a prison wall gives them no rest.

There is no lack of food in Gaza

That doesn't mean the details of the Israeli siege are clear to them. I had the impression that most of the participants knew too little. In their (mistaken ) opinion, the siege began five years ago. And in fact, a Canadian-Syrian doctor asked me in amazement, after I tried to explain something about the denial of right of movement of the Palestinians: "Do you mean to say that the closure in Gaza has been going on for 20 years"? Yes, I said, since 1991.

I explained to a Spanish actor, who had come straight from the 15-M protest encampment in Madrid, that neither Rafah nor the Israel Navy are the main barriers that must be removed to enable the Palestinians in Gaza to have the freedom of movement to which every human being is entitled. "Cutting off the natural link to the West Bank, which is 50 to 70 kilometers away, is the worst thing in terms of the lives of the residents of the Strip," I explained to him. "The fact that Israelis exercise an almost unlimited right to move around and live between the sea and the river, while the Palestinian are dependent on a regimen of permits and prohibitions and their movement is restricted although they live in the same country - this is the essence of the closure and the demographic separation."

In other words, concluded the Spaniard, "During the entire information campaign of the flotilla, we were talking about the wrong thing." And with a few body movements, without words, he said: "Yallah, then I'm getting out of here." A Danish activist seemed displeased when I exceeded my role as a journalist and said, in one of the preparatory meetings on the boat Tahrir, that it was a mistake to talk about "a humanitarian mission" in addition to a political one. How fortunate I didn't say that all the insistence on bringing material assistance has its roots in a religious mentality of giving charity.

But I did repeat the words of my friends in Gaza: "We are not lacking food. Nor clothing and electrical appliances. Medications are lacking because of the quarrel between Ramallah and Gaza. What we lack is the freedom to come and go, to study, to manufacture and export, to go on vacation, to visit friends, to host people here. Like all human beings."

Activists from each boat were asked to send their "VIPs" to one press conference in Athens, when the depth of Greece's commitment to preventing the sailing was not yet understood - Alice Walker from the American ship, for example, and Swedish writer Henning Mankell. The VIP from the Canadian boat Tahrir (which also had the Danish, Australian and Belgian delegations ) was Bob Lovelace - a member of the Ardoch Algonquin First Nation and formerly its chief - who has experience in struggles against the harassments of white rule and is a professor of the history of the First Nations. He is 60-years-old, and this was his first trip to Europe.

Appetite for freedom

As such he represented, for example, the Belgian doctor in his fifties who, as a young man, was ousted from the doctors' association because his small car did not suit his prestigious status, because he distributed leftist flyers to the workers and - mainly - because he charged too little. A protest by his patients led to his reinstatement in the association.

Lovelace also represented, among others, a Canadian feminist who works in a shelter for battered women, who is an advocate for the rights of members of the First Nations and plans to run for Parliament on behalf of a Quebecois slate (she is also transsexual ); a former member of Copenhagen's collective mayorship/leadership; a man who was a Belgian war correspondent for 25 years ("and that's why I'm a pacifist" ); a Canadian social activist who, in the late 1980s, worked with opponents of apartheid in South Africa; and an Indian-Kashmiri born in Zambia, who was on a peace mission in Iraq with "the Christian peace teams" and was kidnapped and held for four months in captivity.

In their calculated willingness to endanger themselves, the participants in the present flotilla expressed their resistance to the diplomatic and political assistance that their governments give Israel, in order to enable the existence of the large prison called Gaza.

They didn't reach Gaza. They still have something to learn about the siege. But in their countries and their societies, they expand the essence of democracy, as continual civic participation that is motivated by an appetite for freedom and is not satisfied with voting only. We can only hope that the ripples from there will reach the country between the river and the sea.

احتفلت النساء الأمريكيات في أغسطس الماضي بمرور تسعين عاما على منحهن حق الاقتراع. رحلة طويلة من الحراك النسائي خاضتها المرأة الأمريكية، أسرد عليكم الجزء الأخير من قصة النضال الطويلة هذه والتي بلغت أشدها خلال الحرب العالمية الأولى عندما تقلدت النساء وظائف الرجال الراحلين للحرب في المصانع وقاموا بجهد فعال لدعم الحرب أكثر من الحروب السابقة التي خاضتها أمريكا. فخلال الحرب وبعد انتهائها لم تفتر حماسة الناشطات الأمريكيات بالضغط على الحكومة آنذاك لمنحهم حق الاقتراع فنظمن المظاهرات أمام البيت الأبيض وفي مختلف الولايات وأقمن المؤتمرات الصحفية وسجنت الكثيرات وقامت قائدة إحدى الحملات الناشطة أليس بول،التي وصفتها الناشطات الأخريات بالراديكالية المتمردة، بإعلانها الإضراب عن الطعام من السجن ليتم إطعامها البيض النيئ عنوة عبر أنبوب من قبل سجانيها.

كل هذا الإصرار والتغطية الصحفية المكثفة لعزم النساء وقتها شكلت قوة ضغط على الرئيس الأمريكي حينها وودرو ويلسون الذي أعلن تضامنه معهن في خطابه الشهير الثامن عشرة من سبتمبر 1918 قائلا «لقد جعلنا من النساء شريكات في الحرب. هل نشاركهن فقط التضحية والمعاناة ونمنعهن المشاركة في حقهن؟» في أقل من سنة بغالبية 304 أصوات مقابل 90 صوتا صدق مجلس الشيوخ الأمريكي على اقتراح إضافة المادة التاسعة عشرة للدستور الأمريكي والتي تنص على الآتي: «لمواطني الولايات المتحدة الأمريكية الحق في الاقتراع والذي لا يحق للحكومة أو الولايات منعه أو اجتزاءه بناء على جنس المقترع. ويكون للكونجرس بناء علي صلاحياته القانونية أن يفعل هذه المادة.» وفي الشهر التالي صوت مجلس النواب مؤيدا المادة الجديدة بغالبية 56 صوتا مقابل 25 ثم قاموا بإرساله إلى كافة الولايات للتصويت عليه. كانت ولاية اللينوي وميشيغان وويسكونسون أول الولايات التي تقر المادة الجديدة في حين سارعت ولايتا جورجيا وألاباما الجنوبيتان في رفضه. وفي مقابل قبول وتعاطف غالبية الساسة الأمريكيين لحق النساء في الاقتراع بالتوازي مع الحملات النسائية المطالبة كان صوت المعارضين عاليا أيضا ومنظما لحد كبير وشاركت النساء الرجال فيه لإعلان رفضهن لمطالب قريناتهن.

للتصديق على مادة الاقتراع الجديدة في الدستور وجب تأييد 36 ولاية لذلك عندما وصل العدد إلى 35 ولاية حج المعارضون والمؤيدون من مختلف الولايات إلى ولاية تنيسي وعاصمتها ناشفيل لحشد القوى، فتنيسي ستحسم المعركة بالتصديق أو الرفض. كان السجال حامي الوطيس والكفتان شبه متعادلتين لكن أحد المشرعين في الولاية البالغ من العمر 24 عاما ويدعى هاري بيرن والذي سبق له أن صوت لصالح الحركة المضادة لحملة اقتراع النساء سيدخل التاريخ الأمريكي عندما استجاب لرغبة والدته التي ألحت عليه وطلبت منه دعم حق الاقتراع للمرأة. فعندما وجد أن الاقتراع بات قريبا وأنه لو صوت بالرفض كانت النتيجة ستكون 48 صوتا مقابل 48 أيضا قرر أن يصوت كما طلبت منه أمه لصالح حق المرأة في الاقتراع وبذلك في الثامن عشر من أغسطس العام 1920 أصبحت تنيسي الولاية السادسة والثلاثون التي أقرت المادة التاسعة عشرة في الدستور الأمريكي على الرغم من محاولة المعارضين للمناورة البرلمانية لتأخير تصديق الولاية قانونيا على المادة الجديدة في محاولة لاستمالة رأي بعض المؤيدين المشرعين لصفهم لكن محاولاتهم باءت بالفشل وأرسل حاكم الولاية البلاغ القانوني اللازم إلى واشنطن لإعلامهم بتصديق تنيسي للمادة التاسعة عشرة. وعليه في السادس والعشرين من أغسطس 1920 أصبحت المادة التاسعة عشرة من الدستور الأمريكي قانونا نافذا واستطاعت النساء الاقتراع في خريف العام نفسه وأيضا في الانتخابات الرئاسية.

كيف تستفيد الكاشيرات السعوديات وبقية النساء اللواتي يطمحن في حرية العمل وهن يواجهن اعتراض وامتعاض البعض من بحثهن عن لقمة العيش الشريفة من تجربة المرأة الأمريكية قبل تسعين عاما؟ الكثير والكثير. أولها أن طريق الحصول على الحقوق ليس مفروشا بالزهور وأن من تطالب بحقها لا تتوقع أن يقدم لها على طبق من فضة وأن يتم في يوم وليلة، ما نزرعه الآن ستحصدها حفيدات حفيداتنا يوما ما بلاشك. نتعلم أيضا أن المثقفة المناضلة أليس بول دكتورة القانون وغيرها الكثيرات من المتعلمات مثلها لم يقبعن في حلقتهن الصغيرة البرجوازية الضيقة واكتفين بالحديث مع أنفسهن بل خرجن إلى الشوراع ووقفن جنبا إلى جنب مع عاملات المصانع بل وسجن قبلهن. درس مهم آخر نستشفه هو أن معركة الحقوق النسائية الأمريكية ساهم الرجل فيها بشكل كبير مساندا وسياسيا ومشرعا لذلك وجب إشراك الرجل السعودي في العمل النسائي وتوخي السبل الصحيحة لاستمالته وفتح قناة حوار مع المعارضين الذكور. والأهم من كل ذلك كما أعتقد هو قوة القانون الذي تتكئ عليه الدول القوية المستقرة المزدهرة الاقتصاد فعلى الرغم من تقارب أعداد المؤيدين والمعارضين حينها إلا أن صوتا واحدا كان كفيلا بحسم الموضوع ليحترم المخالفون قرار الأغلبية.

البداية التي تستطيع كل امرأة سعودية تطبيقها هي المطالبة بتطبيق الاتفاقية الدولية «القضاء على التمييز ضد المرأة» المعروفة بالسيداو والتي أقرتها المملكة في 12 ديسمبر 2000م وعليه كما أكدت هيئة حقوق الإنسان والجمعية الوطنية لحقوق الإنسان في حال تعارض بند من بنود الاتفاقية مع إجراء أو نص محلي يخالفها يحق للقاضي السعودي الاستناد مباشرة إلى مادة الاتفاقية لإلغاء وإبطال كل ما يتعارض معها. كتبت مرات عديدة عن السيداو وحاولت شرح أهميتها البالغة وكم تمنيت ولا أزال أن ترسل لي إحدى القارئات مستفسرة عنها. أخواتي الحل بين أيديكم حقكم في العمل الشريف وحرية الاختيار لابد أن يشرع ويصان كي لاتمتهنه جهة العمل قبل المعارضين، وكل عام و نحن حرائر كما ولدتنا أمهاتنا.

A Book Review

I just finished reading Kai Bird’s “Crossing Mandelbaum Gate: Coming of Age Between the Arabs and Israelis, 1956-1978.” It’s one of those books that you love and hate, engaging in some chapters and yet long and boring in others. Bird is a son of a US diplomat who lived with his family through out the Middle East during some troubling times. Through his book he provides mini-portraits of his life in Jerusalem, Saudi Arabia, Egypt, Lebanon and the US intertwined with a historical narrative of certain historical events.

First, I have some reservations when people have vivid memories of their early childhood (we are talking about remembering political unrest when you are 4; Bird was 4 when his family moved to Jerusalem in 1956). This transformed the first few chapters of the book into a history book instead of a memoir. Second, Bird strangely and astonishingly was in the right place at the right time ALL the time. He was one lucky son of a US diplomat. He was in Jerusalem in 1956 when the Suez War started; he was in Dhahran, Saudi Arabia in 1962 witnessing the apartheid-like culture of the American Camp of the Saudi Oil Company (Aramco); he was in Jeddah, Saudi Arabia when King Faisal imposed the oil embargo on the States in 1973; met and socialized with Salem bin Laden in the 1970’s in Jeddah; lived in the same neighborhood as Ayman al-Zawahiri (although did not encounter him) in Cairo in 1965; he was in Cairo when the 1967 Six-Day War broke out (the Naksa); he was in the US when the anti-Vietnam War movement was at its height in 1969-70; he was living in a village in Lebanon overlooking the airport where the PLO hijacked commercial airplanes during Black September in 1970; his girlfriend was actually in one of the hijacked airplanes … While reading the book, I kept questioning the beautiful coincident that managed to put him in the right place through out history. He even acknowledged that his own 3 sisters were mentioned very infrequently during the book and might not related to his experience since their life experience/history is quite different from his.

Despite the fact that the author was relatively young during some of these historical events, he managed to captivatingly, sometimes, combine history with personal experience. However, for a person who is narrating history, he was unfair at times. Despite his claim of sympathizing with the Palestinian cause, it seems that the Israeli side of the story was more profound and much more detailed at times. Once again, we are talking about the historical reporting part not the personal memories. When a person is talking about his or her own memories and how they perceived certain historical or political events, nobody could question these memories because of their personal nature. However, when it comes to historical narrative, the analysis differs. History is owned by its narrator, but this does not justify bias.

His intake on the Black September and King Hussain’s reaction to the threat of the Palestinians taking over Jordan is quite interesting. Similar was his intake on the PLO taking over Lebanon. It seems that this take over justified King Hussain’s bloody reaction to the Palestinians and the Israeli invasion of Lebanon.

I was mildly disturbed by some of the “facts” and “justifications” mentioned in his book until I reached the chapter where he started discussing how the Nakbah should not be compared to the Holocaust. This started when he went on a “fact-finding” mission with a delegation of journalist to Lebanon in 1978 (p.337) right after Israel invaded Lebanon. He talked about the conductors of the mission forcing the Palestinian version of events down the journalists’ throats and how unprofessional this was (have he heard of the Birth Right Tours conducted by the Israeli government?). When they were at the PLO office, the priest working there compared the Nakbah to the Holocaust. As a protest, he decided to leave. Jews “have a monopoly on that particular word,” he claims. The term, its history and narrative, are OWNED by the Jews. Any comparison is illegitimate and baseless. For instance, he chose to talk in details about the Israeli historian Benny Morris. Interestingly enough, there was no mention of Ilan Pappe, another pronounced Israeli historian. One wonders, is it because Ilan Pappe characterized the Israeli’s conduct prior and right after 1948 as an ethnic cleansing of the Palestinians?

After a lengthy and quite interesting section about his wife’s parents’ stories surviving the Holocaust, I was left wondering how come the Nakba, or the ethnic cleansing of the Palestinian population in 1948, did not receive even half the coverage the Holocaust stories did. I understand the personal connection here, since it was his wife’s parents after all. However, looking at the historical nature of the book, one would wonder why the Nakba was referenced very briefly without much detail despite the heavy role it plays in the Palestine-Israel conflict that seemed to be the underlying issue of his narrative. It was mentioned three times; once when he was talking about Leila Khaled (one of the 1970 plane hijackers); when the comparison was made by the PLO priest in 1978; and finally when he was talking about the historian Benny Morris. Benny Morris, the well known racist and ethnic cleansing justifier, according to Bird’s book, legitimized the Palestinian narrative through his books. When Morris was mentioned, however, the author did not forget to mention that this unbiased historian, who has legitimized the Palestinian narrative and yet has no Palestinian friends, still advocates for a complete separation between the Palestinians and the Israelis and considers the apartheid wall a necessity. A view he adopted as a result of the Palestinian Intifada. A reasonable reaction since the Palestinian’s choice of picking up arms against the Israelis during the Intifada (or the plane hijacking in 1970) was the worst choice to adopt against the generation with the Holocaust engraved in their collective memory. This collective memory sounds puzzling, and sometimes contradictory, at times. I am not talking about the historical evet or doubting it existence. This would be ludicrous. The puzzling aspect is how this generation, that never forgets the Holocaust, has reacted, used, and exploited it. According to Bird, it is a generation that viewed Holocaust survivors as weak and unworthy of survival (Ben-Gurion has said “among the survivors of the German concentration camps there were people who would not have survived of if they had not been what they were – hard, evil, and selfish people – and what they underwent there served to destroy what good qualities they had left.” (p.339)). This collective memory gets more questionable when the tactics utilized during the ethnic cleansing of the Palestinian period were similar to the ones used by the Nazis (by the Irgun, which he relatively praises in another chapter). This generation utilized, and still utilizes, fear, terror, and ghettoization of an entire population for over 60 years. They own the Holocaust; they own the narrative; and nobody should dare compare it to any other historical event. With it comes an entitlement to deploy any measure to feel safe; and yet any retaliation is intolerable because it awakens that deeply engraved fear.

Bird went even as far as justifying Israel’s frequent disproportionate use of force because “Israelis believe in the marrow of their bones that the are alone in the world, and that any attack must be met with overwhelming force because – never again.” He further claims “there has never been a high-profile, politically viable Palestinian Gandhi.” This is a gross ignorance of the long history of the peaceful non-violent struggle the Palestinians have been going through. A simple search would reveal a multiple number of Palestinian min-Gandhi’s. For a writer and a journalist, ignoring this research and making such a statement cannot be overlooked. After all that, he goes as far as saying that the Palestinians are the ones who are “drenched in victimhood” and should move on (p.340). So, according to the author, the Palestinians should accept the use of disproportionate force against them; never use force; and stop being victims.

On a different point, the chapters talking about Saudi Arabia, the Saudi national oil company (Aramco), the CIA’s role in the early years of Aramco, the apartheid system that was adopted by the American management of Aramco (against the locals) in the 50’s and 60’s were quite interesting. The chapters have fascinating details about how Aramco was the US government’s representative in Saudi (or at least treated as such by the Saudi government); how its government relations department was staffed by CIA agents; how the US management used cold water coolers and clean bathrooms that had signs saying “Americans Only” on them, while the locals used significantly worse facilities; and finally some details about the Saudi workers’ uprising and how the government responded to such uprising.

I have to say that I have enjoyed the book for different reasons. It managed to make me mad at some points. It kept me entertained and fascinated in other parts. And it bored me in others. One of the most fascinating experiences one could have with a book is when he or she develops a personal relationship with the book: a love-hate-intrigue relationship.

Thinking outside the national mold and trying to criticize your own country while everybody arounds you says that mere criticism is unpatriotic is a brave thing to do. Questioning everything you were raised to believe; forming your own opinion independent of such mold is both admirable and unnatural. That's why I have such admiration for critical Israeli journalist. Journalists like Joseph Dana, Larry Derfner, Gideon Levy, Amira Hass, Noam Sheizaf and many others.

While reporting on the recent "Welcome to Palestine" campaign, Larry Drefner raises some major points.

"Most Israelis, even if they wouldn’t join a mob like the one at the airport, want to hear the belligerent rhetoric the opinion-makers are feeding them. They hate anybody who says anything bad about Israel, and take their words automatically as “blood libels.” The opinion-makers know this, and the ones who are popular and want to stay that way tell the people what they want to hear.

Who’s manipulating whom is a chicken-and-egg question."

In another passage, he says, beautifully: "Which is why these foreign activists on these flotillas, whatever I or anybody else thinks of the totality of their politics, are absolutely vital not only to the Palestinians, but to Israel. They’re bringing oxygen to a suffocating nation."

Mobocracy at Ben-Gurion Airport

Journalist Larry Derfner came to Tel Aviv airport to cover the arrival of international activists. Once in the reception hall, a small Israeli mob turned on him. In a matter of seconds, he found himself in a police van

Anybody who believes the platitude that the people want peace, it’s just the leaders who want war, should have been at Ben-Gurion Airport today. It’s a good thing those Free Palestine activists got arrested; otherwise, the little mob that formed spontaneously would have punched them up pretty good.

Only minutes after I got to the Arrivals hall, a few activists stood in front of the phalanx of reporters and cameramen, help up their little signs and started chanting “Israel Apartheid” and ”Free Palestine!” The cops tore the signs from their hands and started pushing them toward the exit. After the first couple of minutes of watching in shocked silence, people in the terminal started to boo. Men were cursing loudly – “sons of bitches,” “garbage,” and things in Arabic I didn’t understand.

A couple of dozen people, mainly men but also a few women, followed very close behind the tightly-bunched demonstrators, cops and reporters to the police van. “Throw them in the garbage,” shouted one woman. An old man tried to get at one of the activists, but the police stopped him.

I was there ostensibly as a journalist, and I was scribbling notes, but I felt cowardly not saying anything to these nationalist hooligans, so I started telling them in Hebrew, “What are these people doing?” The woman who wanted them thrown in the garbage said, “They’re hurting us!” I said, “They’re talking,” and the little mob turned on me, a couple of the men raised their fists. The woman told me, “Go back home, get out of here,” I said, “I live here.” The cops mistook me for a demonstrator, put me in the police van, but when I showed them my press card, they let me go.

Let me repeat – the police started off arresting the demonstrators, but very shortly their main task was to keep them from being assaulted. They had to hold back the herd = and that’s what these people were, a herd incited by the idea that these protesters, non-violent protesters trying to get to the West Bank, were a menace, an immediate threat to their security.

And I do not buy the idea that these people are helpless pawns being manipulated by the government, the media, the right-wing politicians. Most Israelis, even if they wouldn’t join a mob like the one at the airport, want to hear the belligerent rhetoric the opinion-makers are feeding them. They hate anybody who says anything bad about Israel, and take their words automatically as “blood libels.” The opinion-makers know this, and the ones who are popular and want to stay that way tell the people what they want to hear.

Watching my enraged countrymen at Ben-Gurion, I imagined the daily headlines having been distilled into a kind of political methadrine and mainlined into their veins. Few Israelis would join them in physically going after people chanting slogans. But in their insistence that protesters like these be silenced because their words are acts of violence, acts of war, of terrorism, they represent the majority. They are an authentic expression of the national will. Theirs is the loudest voice in the land, it’s joined by the voice of Netanyahu, the government, the settlers and most of the media. All competing voices are drowned out.

Which is why these foreign activists on these flotillas, whatever I or anybody else thinks of the totality of their politics, are absolutely vital not only to the Palestinians, but to Israel. They’re bringing oxygen to a suffocating nation.

هل نحارب طواحين الهواء؟

لقد عاش المسلمون أزهي عصورهم وحكموا العالم وأبدعوا حضارتهم العظيمة عندما كانوا يعيشون في ظل الخلافة الاسلامية التي تحكم بشريعة الله .. في العصر الحديث نجح الاستعمار في اسقاط الخلافة وتلويث عقول المسلمين بالأفكار الغربية، عندئذ تدهورت أحوالهم وتعرضوا الى الضعف والتخلف.. الحل الوحيد لنهضة المسلمين هو استعادة الخلافة الاسلامية..».

كثيرا ما استمعت الى هذه الجملة من بعض خطباء المساجد وأعضاء الجماعات الاسلامية ولا شك في أن كثيرين في مصر والعالم العربي يؤمنون بصحة هذه المقولة مما يجعل من الواجب مناقشتها. الحقيقة أن الاسلام قدم فعلا حضارة عظيمة للعالم فعلى مدى قــرون نبغ المسلمــون وتفــوقوا في المجالات الانسانية كلها بدءا من الفن والفلسفة وحتى الكيمياء والجبر والهندسة.. أذكر أنني كنت أدرس الأدب الأسباني في مدريد وكان الأستاذ يدرسنا تاريخ الأندلس وفي بداية المحاضرة عرف أن هناك ثلاثة طلبة عرب في الفصل فابتسم وقال لنا:

«يجب أن تفخروا بما أنجزه أجدادكم من حضارة في الأندلس…».

الجزء الأول من الجملة عن عظمة الحــضارة الاسلامية صحـيح تمـاما.. المشكــلة في الجزء الثاني… هل كـانت الدول الاسلامـية المتعاقبة تطبق مبادئ الاسلام سواء في طريقة توليها للحكم أو تداولها للسـلطة أو معــاملتها للرعية ..؟! .. ان قراءة التاريخ الاسلامي تحمل لنا اجابة مختلفة.. فبعد وفاة الرسول لم يعرف العالم الاسلامي الحكم الرشيد العادل الا لمدة 31 عاما هي مجموع فترات حكم الخلفاء الراشدين الأربعة: أبو بكر الصديق وعمر بن الخطاب وعثمان بن عفان وعلي بن أبي طالب.. الذين حكموا جميعا لمدة 29 عاما ثم الخليفة الأموي عمر بن عبد العزيز الذي حكم لفترة عامين.

31 عاما فقط من 14 قرنا من الزمان، كان الحــكم فيها عادلا رشيدا نقيا متوافقا مع مبـادئ الاسلام الحقــيقية، أما بقية التاريخ الاسلامي فإن نظام الحكم فيه لم يكن متفقا قط مع مبادئ الدين.. حتى خلال الـ31 عاما الأفضل، حدثت مخالفات من الخليفة عثمان بن عفـان، الذي لم يعدل بين المسلمين، وآثر أقاربه بالمناصــب والعــطايا، فثار عليه الـناس وقتلوه، ولم يكتفوا بذلك بل هاجموا جنازته وأخرجوا جــثته واعتدوا علــيها حتى تهــشم أحد أضلاعه وهو ميت… ثم جاءت الفتنة الكبرى التي قسمت المسلمين الى ثلاث فرق (أهل سنة وشيعة وخوارج) وانتهت بمقتل علي بن أبي طالب، وهو من أعظم المسلـمين وأفقـههم وأقربهم للرسول على يد أحد الخوارج وهو عبد الرحمن بن ملجم. ثم أقام معاوية بن سفيان حكما استبداديا دمويا أخذ فيه البيعة من الناس كرها لابنه يزيد من بعـده ليقضي الى الأبد على حق المسلمين في اختيار من يحكمهم، ويحيل الحكم من وظيفة لاقامة العــدل، الى مــلك عضوض (يعض عليه بالنواجذ). والقارئ لتاريخ الدولة الأموية ستفاجئه حقيقة أن الأمويين لم يتورعوا عن ارتكاب أبشع الجرائم من أجل المحافظة على الحكم… فقد هاجم الأمويون المدينة المنورة وقتلوا كثيرا من أهلها لإخضاعهم في موقعة الحرة، بل ان الخــليفة عــبد الملك بن مروان أرسل جيشا بقيادة الحـجاج بن يوســف لإخضاع عبد الله بن الزبير الذي تمرد على الحكم الأموي واعتصم في المسجد الحرام… ولقد حاصر الحجاج مكة بجيشه وضرب الكعبة بالمنجنيق حتى تهدمت بعض أركانها ثم اقتحم المسجد الحرام وقتل عبد الله بن الزبير داخله…

كل شيء إذاً مباح من أجل المحافظة على السلطة حتى الاعتداء على الكعبة أقدس مكان في الاسلام. وإذا انتقلنا الى الدولة العباسية ستطالعنا صفحة جديدة من المجازر التي استولى بها العباسيون على السلطة، وحافظوا عليها. فقد تعقب العباسيون الأمويين وقـتلوهم جميعا بلا ذنب ولا محاكمة، ونبشوا قبور الخلفاء الأمويين وعبثوا بجثثــهم انتقاما منهم.. الخليفة العباسي الثاني أبو جعفر المنصور قتل عمه عبد الله خوفا من أن ينازعه في الحكم، ثم انقــلب على أبي مسلم الخراساني الذي كان سببا في اقامة الدولة العباسية فقتله. أما أول الخلفاء العباسيين فهو أبو العباس السفاح الذي سمي بالسفاح لكثرة من قتلهم من الناس، وله قصة شهيرة جمع فيها من تبقى من الأمراء الأمويين وأمر بذبحهم أمام عينيه، ثم غطى جثثهم ببسـاط ودعا بطعام وأخذ يأكل ويشرب بينما لا زالوا يتحركون في النزع الأخير ثم قال:

«والله ما أكلت أشهى من هذه الأكلة قط».

أما من ناحية الالتزام الديني، باستثناء بضـعة ملوك اشتهروا بالورع فقد كان معظم الملوك الأمويين والعباسيين يشربون الخمر مع ندمائهم على الملأ كل ليلة… فلسفة الحكم إذاً لم يكن لها علاقة بالدين من قريب أو بعيد، بل هو صراع شرس دموي على السلطة والنفوذ والمال، لا يتورعون فيه عن شيء حتى لو كان الاعتداء على الكعبة وهدم أركانها… فلا يحدثنا أحد عن الدولة الاسلامية الرشيدة التي أخذت بالشريعة، لأن ذلك ببساطة لم يحدث خلال 14 قرنا الا لفترة 31 عاما فقط.

السؤال هنا ما الفرق بين الحكم الاسلامي الرشيد الذي استمر لسنوات قليلة وبين ذلك التاريخ الطـويل من الاستبداد باسم الاسلام.. انه الفرق بين العدل والظلم، بين الديموقراطية والاستبداد.. ان الاسلام الحقيقي قد طبق الديموقراطية الحديثة قبل أن يطبقها الغرب بقرون طويلة.. فقد امتنع الرسول صلى الله عليه وسلـم عن اختيار من يخلفه في حكم المسلمين واكتــفى بأن ينـتدب أبا بكر لكي يصلي بالمسلــمين بدلا منه، وكأنه يريد أن يرسل الاشارة أنه يفضل أبا بكر لخلافته بدون أن يحرم المسلمين من حقهم في اختيار الحاكم.. وعندما توفي الرسول اجتمع زعماء المسلمين في سقيفة بني ساعدة ليختاروا الخليفة، هذا الاجتماع بلغتنا الحديثة اجتماع برلماني بامتياز تداول فيه نواب المسلمين الأمر ثم انتخبوا أبا بكر ليتولى الحكم، وقد ألقى أبو بكر على المسلمين خطبة قال فيها:

«يا أيها الناس لقد وليت علـيكم ولست بخيركم.. أطيعوني ما أطعت الله ورسوله فإن عصيتهما فلا طاعة لي عليكم»

هذه الخطبة بمثابة دستور حقــيقي يحدد العلاقة بين الحاكم والمواطنين كأفضل دستــور ديموقــراطي. نلاحظ هنا أن أبا بكر لم يقل إنه خليــفة الله ولم يتــحدث عــن حق إلهي في الحكم بل أكد أنه مجرد واحد من الناس وليس أفضلهم. هذا المفهوم الديموقراطي الذي هو جوهر الاسلام سيستمر سنوات قليلة ثم يتحول الى مفـهوم آخر مناقض يعتبر الحاكم ظل الله على الأرض فيقول معاوية بن أبي سفيان:

« الأرض لله وأنا خليفة الله، فما أخذت فلي وما تركته للناس فبفضل مني».

ويقول أبو جعفر المنصور العباسي:

« أيها الناس لقد أصبحنا لكم قادة وعنكم ذادة (حماة) نحكمكم بحق الله الذي أولانا وسلطانه الذي أعطانا وأنا خليفة الله في أرضه وحارسه على ماله».

ويقول عبد الملك بن مروان وهو يخطب على منبر النبي:

«والله لا يأمرني أحد بتقوى الله بعد مقامي هذا إلا ضربت عنقه».

انقلب المفهوم الديموقراطي الذي يمثل جوهر الاسلام الى حكم بالحق الالهي يعتبر المعترضين عليه كفارا مرتدين عن الدين يجب قتلهم . يقتضينا الإنصاف هنا أن نذكر حقيقتين: أولا أن الخلفاء الذين تولوا الحكم عن طريق القتل والمؤامرت كانوا في أحيان كــثيرة حكامـا أكفاء أحسنوا ادارة الدولة الاسلامية حتى أصبحت امبراطورية ممتدة الاطراف، لكن طريقتهم في تولي السلطة والحفاظ عليها، لا يمكن بأي حال اعتبارها نموذجا يتفق مع مبادئ الاسلام …ثانيا أن الصراع الدموي على السلطة لم يقتصر على حكام المسلمين في ذلك العصر بل كان يحدث بين ملوك اوروبا بالطريقة نفسها من أجل انتزاع العروش والمحافظة عليها..

الفرق أن الغربيين الآن يعتبرون هذه الصراعات الدموية مرحلة كان لا بد من اجتيازها من أجل الوصول الى الديموقراطية، بينما ما زال بيننا نحن العرب والمسلمين من يدعو الى استعادة نظام الخلافة الاسلامية، ويزعم أنها كانت عادلة تتبع شريعة الله. ان التاريخ الرهيب للصراع السياسي في الدولة الاسلامية منشور ومعروف وهو أبعد ما يكون عن شريعة الاسلام الحقيقية، وقد احترت في هذه الدعوه الغريبة الى استعادة الخلافة الاسلامية فوجدت من يتحمسون لها نوعين من الناس: بعض المسلمين الذين لم يقرأوا التاريخ الاسلامي من أساسه أو أنهم قرأوه وتهربوا من رؤية الحقيقة لأن عواطفهم الدينية قد غلبت عليهم فأصبحوا بالاضافة الى تقديس الاسلام يقدسون التاريخ الاسلامي نفسه ويحاولون اعادة تخيله بما ليس فيه. أما الفريق الآخر من المنادين بالخلافة فهم أعضاء جماعات الاسلام السـياسي، الذين يلعبون على عواطف البسطاء الدينية من أجل أن يصلوا الى السلطة بأية طريقة.. وهم يخيرونك عادة بين طريقــين: اما أن توافق على صورتهم الخيالية عن الخلافة وإما أن يتهموك بأنك علماني عدو الاسلام. اما أن تساعدهم على الوصول الى الحكم عن طريق نـشر أكـاذيب وضـلالات عن التـاريخ، وإلا فإن سيف التكفير في أيديهم سيهوون به على عنقك في أي لحظة.

جوهر الاسلام العدل والحرية والمساواة.. وهذا الجوهر تحقق لفترة قصيرة عندما تم الأخذ بمبادئ الديموقراطية .. أما بقية تاريخ الحكم الاسلامي فلا وجود فيه لمبادئ أو مثل نبيلة بل هو صراع دموي على السلطة يستباح فيه كل شيء حتى ولو ضربت الكعبة وتهدمت أركانها.. هذه الحقيقة شئنا أم أبينا. أما السعي لانتاج تاريخ خيالي للخلافة الاسلامية الرشيدة فلن يخرج عن كونه محاولة لتأليف صور ذهنية قد تكون جميلة لكنها للأسف غير حقيقية.. كتلك التي وصفـها الكاتب الاسباني الكبير ميغيل دي سرفانتس في قصته الشـهيرة دون كيخوته حيث يعيش البطل العجوز في الماضي مستغرقا في قراءة الكتب القديمة، حتى تستبد به الرغبة في أن يكون فارسا بعد ان انقضى زمن الفرسان فيرتدي الدرع ويمتشق السيف ثم يتخيل أن طواحين الهواء جيوش الأعداء فيهجم عليها ليهزمها.

الطريق الوحيد للنهضة هو تطبيق مبادئ الاسلام الحقيقية: الحرية والعدل والمساواة .. وهذه لن تتحقق الا بإقامة الدولة المدنية التي يتساوى فيها المواطنون جميعا أمام القانون بغض النظر عن الدين والجنس واللون..

Are we listening to ourselves? Are we still aware of the awful noise coming from here? Have we noticed how the discourse is becoming more and more violent and how the language of force has just about become Israel's only official language?

A group of international activists is slated to sail a flotilla to the shores of the Gaza Strip. Many of them are social activists and fighters for peace and justice, veterans of the struggle against apartheid, colonialism, imperialism, pointless wars and injustice. Just stating that is difficult here, since they have already been described as thugs.

There are intellectuals, Holocaust survivors and people of conscience among them. When they fought against apartheid in South Africa or the war in Vietnam, they won admiration for their actions even here. But to say an admiring word now about these people, some of whom are elderly, who are risking their lives and investing their money and time for a goal they see as just, is considered treason. It's possible that some violent people have intermingled with them, but the vast majority are people of peace, not haters of Israel but those who hate its injustices. They have decided not to remain silent - to challenge the existing order, which is unacceptable to them, which cannot be acceptable to any moral person.

Yes, they want to create a provocation - the only way to remind the world about Gaza's situation, in which no one takes an interest unless Qassam rockets or flotillas are involved. Yes, the situation in Gaza has improved in recent months, in part because of the previous flotilla. But no, Gaza is still not free - far from it. It has no outlet to the sea or air, there are no exports, and its inhabitants are still partially imprisoned. Israelis who freak out if Ben-Gurion International Airport shuts down for two hours should be able to understand what life without a port is like. Gaza is entitled to its freedom, and those aboard the flotilla are entitled to take action in an effort to achieve this. Israel should be allowing them to demonstrate.

But look at how Israel is reacting. The flotilla was described immediately, by everyone, as a security threat; its activists were classified as enemies, and there was no doubt cast on the ridiculous assumptions that defense officials are making and the press has lapped up eagerly. We haven't heard the last of the campaign to demonize the previous flotilla, in which Turkish citizens were killed for no reason, yet the new campaign has already begun. It has all the buzzwords: danger, chemical substances, hand-to-hand combat, Muslims, Turks, Arabs, terrorists and maybe some suicide bombers. Blood and fire and pillars of smoke!

The unavoidable conclusion is that there is only one way to act against the passengers aboard the flotilla: by force, and only by force, as with every security threat. This is a recurring pattern: first demonization, then legitimization (to act violently ). Remember the tall tales about sophisticated Iranian weaponry coming through arms-smuggling tunnels in Gaza, or those about how the Strip was booby-trapped? Then Operation Cast Lead came along and the soldiers hardly encountered anything like that.

The attitude toward the flotilla is a continuation of the same behavior. The campaign of scare tactics and demonization is what contributes to the violent rhetoric that is taking over the entire public discourse. For what will Israelis think about when they are spoon-fed scary stories about the flotilla, if not about the use of force? Those activists want to kill Israel Defense Forces soldiers? We'll arise and kill them first.

Now the politicians, the generals and the commentators are competing with one another over who can provide the most frightening description of the flotilla, who can most inflame the public, who can best praise the soldiers who will save us, and who can deliver the most pompous rhetoric of the kind one would expect before a war. One important commentator, Dan Margalit, has already waxed poetic in his newspaper column: "Blessed are the hands," he wrote of the hands that sabotaged one of the ships meant to take part in the flotilla. That's another thuggish and illegal action, one that wins immediate applause here, without anyone asking: By what right?

This flotilla, too, will not get through. The prime minister and the defense minister have promised us this. Once again Israel will show them, those activists, who's more of a man - who's strongest and who's in charge, in the air, on land and at sea. The "lessons" of the previous flotilla have been learned well - not the lessons of the pointless killing or the violent and unnecessary takeover of the ship, but of the humiliation of Israel's military.

But the truth is the real humiliation lies in the fact that naval commandos were deployed to intercept the ships in the first place, and that is something that reflects on us all: how we have become a society whose language is violence, a country that seeks to resolve nearly everything by force, and only by force.

في التجربة المدنية تم الطلاق النهائي بين الجماعة والقانون ، ليس من إنسان معترف به إلا فردا ، ثمة قطيعة تامة بين الجماعة والفكر المدني ، الدولة المدنية التي يعيشها الآخرون لم تقم لتحمي الجماعات من شذوذ الأفراد بل لتحمي شذوذ الفرد من سواء الجماعة ، وتاريخ المجتمع الانساني لم يحقق هذه القفزة في العصر الحديث إلا لأنه أدرك الفردية والفردانية وكل مفاهيم الفرد ، المدنية هي الإيمان الكامل بحرية الإنسان فردا واحدا ، ليس ثمة دفترا للعائلة هناك ، لا لأن العائلة ليست قائمة بل لأن الطفل والأب عند القانون سواسية ، والدولة تعترف لكل منهما بوصفه فردا منفصلا عن الآخر ، الدول المدنية لا تميع عشرة أفراد باسم واحد ، ولا تحكم أنثى بذكر ، ولا خادما بكفيل ورب عمل .

لنحقق دولة مدنية علينا أن نفهم أن المحكمة والمدرسة والبنك والمطار والمشفى لا يعرفون مواطنا إلا بنفسه، وجهه وصوته وصورته ، لا يقبلون بالولي والكفيل والمحرم وكل أعمال الحراسة التي تقيم أحدا على أحد ، المدنية لا تضع حدا للعقوق لكنها تعرف معنى البر ، لا تحيل البنات عبيدا لأبائهم باسم الطاعة ، لا ترد المرأة أم الأبناء تحت ولاية أخيها لأنها مطلقة ، المدنية لا تعترف بالعصمة وشهوة الذكر ضعف الأنثى ، لنصل للمدنية علينا أن نعرف كيف نسن قوانينها ، ولنسن القانون علينا أن نؤمن بمفهوم أساسي لا نتجاوزه بأي حال ولا تحت أي ظرف ، الإنسان حرا لا يملكه أحد ، لا أحدا يمكن أن يمسك على أحد باسم المصلحة والدراية وحسن الخلق ، لا أحدا يجوز له التعدي بالمناصحة وترهيب الأنفس والقلوب باسم المعروف والأمر به ، لأن فردا هناك ليس وصياً على فرد ولا جماعة ولا هو أدرى وأعلم وأعرف ولا هو إلى الله أقرب ، في المدنية لا أحد له في أي حال أن يرسم الدولة بطريقه الخاص إلى الله ، لأن الدولة لا تتعدى على الله وتعترف بطريق واحد إليه دون سواه ، الدولة المدنية تؤمن بأن الله أعلى من أن تختار له دينا أو مذهب ، وتعترف أنه يتعالى عن معرفتها ويسمو عن كل محاولاتها الفاشلة في اقامة دولته .

التجربة الانسانية المدنية لم تنجح وهي تظن في نفسها ملكا وشيخا للناس ، إنها تقدمت في اللحظة التي أدركت فيها أنها إنسان ليس إلا ، أدركت المدنية أن إنسانها أقل شئنا من أن يكون أميرا أو بطلا أو داعية ، فالانسان المدني قد أحال الملك صورة تاريخية وقصرا للسياح ، أعاد الشيخ إلى معبده وأفضى طريقه إلى الحياة من كل مدعي العلم والمعرفة والإيمان والأخلاق ، الإنسان المدني رفض أن يسير على خطى غيره ، لم يقبل أن يخوض غيره تجربته الخاصة ، لم يترك المرأة في المنزل لأن الرجل يجد العمل خارجه شاقا ، الأنثى المدنية لم تقبل تجربة الرجال في المناجم والسفن والمصانع لتعتزلها لأنها لم تسخر لها ، لقد خاضت تجربتها الخاصة بها وأدركت أن النساء ليس جنسا من صنف واحد مالا تستطيعه امرأة واحدة لا تستطعنه البقية، المرأة المدنية عرفت أنها ليست أنثى واحدة بل لا عدد لها ولا أصناف ..

تجربة الإنسان المدني هي أولا وأخيرا تجربة فردية ، لم يعد مقبولا ولا ممكنا الحكم على الفرد من خلال آخر، لقد وسعت خيارات الإنسان إلى مالا يمكن أن يحدده ضمن جماعة واحدة يتم التعامل معها كفرد واحد وهم في عددهم ألف أو مليون أو 24 مليون مواطن ، التجربة المدنية أدركت أن الله قادر على أن يخلق هذه الملايين مختلفة عن بعضها لا ينطبق على فرد فيها ماينطبق على غيره ، تركت الأفراد كل منهم إلى نفسه لتجربته لحياته يحدد هو مايريده لها ومالا يريد ، لم تترك لأب أن يحرم ابنه فنه لأنه يؤمن بحرمته ، تركت للولد حقه مع الله ومسؤوليته الشخصية مع خالقه ، لم تسمح للأب أن ينتصب ربا على ابنه ، الدولة المدنية لا تقيم عشرة رجال على مليون مواطن يأتمرون عليهم ويحتسبون ، يحددون أطوال ثيابهم وكثافة لحاهم، يقيمون رجولتهم وفحولتهم ، الدولة المدنية حبست كل المحتسبين عن الناس وأعادت لكل فرد حقه في شكله وملبسه وعبادته ..

المدنية حق الفرد في أن يعيش تجربته الانسانية كاملة كما يريدها ، لا حدود لها إلا أن تمس حدود حرية الآخر ، المدنية لم تسق المجتمع لحكم ألأخلاق فيعيث كل مريض ومهوس ومختل بالآخرين فسادا باسم منامته وعقده الجنسية ومشاكل طفولته ، كسرت عصا أمراء النسب والدين ، كفت يد الأب والمعلم عن جيلها القادم ، المدنية أفضت مابين الناس والله ، تركت لهم حقهم في تجاربهم الايمانية مع ربهم ، لم تسمح لأحد أن يحرم أحدا حقه في عتبه على ربه ، لم تترك لأحد أن يتكلم باسم الله ويسوس الناس كإله ، في المدنية الله تعالى وحده رب الجميع وما هنالك رب للبيت ولا للعمل ولا للمسجد ولا للوطن ..

حق المواطنة، تفتخر به الثقافة الغربية اليوم، وتعتبره من أهم المنجزات الحضارية التي أفرزتها تلك الثقافة خلال القرنين الماضيين، ويقوم حق المواطنة على أساس المساواة في الحقوق والواجبات، بغض النظر عن الانتماء الديني أو العرقي أو المذهبي أو أي اعتبارات أخرى، فالمواطن هو محور الارتكاز الذي تدور حوله كل الحقوق والواجبات.

وإذا كنا منصفين، فإن الحضارة الغربية يحق لها أن تفتخر بهذا الإنجاز الحضاري الذي كرم الإنسان؛ لأنه (إنسان فقط) ولأنه (مواطن فقط). ولكن وإذا كنا منصفين أكثر فيجب أن نعود بالتاريخ إلى 1400 سنة إلى الوراء، عندما هاجر الرسول عليه الصلاة والسلام إلى المدينة المنورة وأبرم ما يعرف (بوثيقة المدينة) والتي كانت بينه وبين سكانها، وكان بها نحو 10 آلاف شخص، منهم 1500 مسلم و4000 يهودي و4500 مشرك.

ونلاحظ هنا أن أطراف هذه الوثيقة كانوا من مختلف الأديان والأعراق والأجناس، إذ إن فيهم المسلم واليهودي والمشرك، وفيهم العربي والفارسي والرومي والحبشي، وفيهم الذكور والإناث، ورغم ذلك فإن الرسول عليه الصلاة والسلام أبرم هذه الوثيقة على أساس (حق المواطنة) وعلى أساس المساواة في الحقوق والواجبات، بغض النظر عن الدين أو العرق أو الجنس، فقد ورد في البند الأول من الوثيقة (أن اليهود أمة مع المسلمين) بمعنى أنهم مواطنون مثل المسلمين، كما ورد في البندين الثالث والرابع (أن أطراف الوثيقة عليهم النصر والعون والنصح والتناصح والبر من دون الإثم)، كذلك أكدت الوثيقة في بندها الحادي عشر (أن الدفاع عن المدينة مسؤولية جميع الأطراف الموقعين على الوثيقة)، كما أكدت بنود الوثيقة على (روح المساواة والعدل والتعاون والتعايش السلمي بين أطرافها).

وهنا يجب أن نقف وقفة تأمل، فإذا كان حق المواطنة أقره الرسول الكريم صلى الله عليه وسلم قبل 1400 سنة، فما بال بعض الدول العربية والإسلامية اليوم قد تخلت عن هذا المبدأ، وأخذت تميز بين مواطنيها تارة على أساس العرق بين عربي وغير عربي، وتارة على أساس الجنس بين رجل و امرأة، وتارة على أساس الجهات بين شمالي وجنوبي وشرقي وغربي، وبلغ الأمر أوج خطورته عندما أصبح التمييز بين المسلمين على أساس الانتماء المذهبي، فإذا كان الرسول عليه الصلاة والسلام قد ساوى بين المسلم واليهودي في حق المواطنة، أليس من الأولى أن نساوي نحن اليوم بين المسلمين في هذا الحق؟ فمن العار أن يكون التمييز بين المواطنين على أساس مذهبي أو عرقي أو مناطقي ...إلخ.

وهنا أيضا يجب أن نسأل أنفسنا سؤالا: لماذا تخلى بعض المسلمون عن هذا المبدأ العظيم الذي أقره الرسول الأكرم في وثيقة المدينة، وتركنا هذا السبق الإسلامي الحضاري الكبير لكي يفوز به العالم الغربي، ويقدمه للعالم كمشروع ثقافي وسياسي وإنساني؟ رغم أن الإسلام هو صاحب هذا المشروع الإنساني والحضاري قبل 15 قرنا مضت؟

والسؤال الأهم: هل آن الأوان لكي يحيي المسلمون هذه السنة، وهذه الفريضة الغائبة من خلال تطبيق حق المواطنة من جديد؟.

The real scandal surrounding Anthony Weiner is that he is bigoted against Palestinians and has misused his position in Congress to support punitive policies against them. Americans appear to be bored by policy, titillated by private peccadilloes. But it is the policies that are important. Mahatma Gandhi was once kicked out of a brothel in South Africa. No one judges him by his lapses. Weiner, in contrast to Gandhi, has not worked for peace but has rather given knee-jerk support to the worst policies of the most far rightwing parties in Israel toward Palestinians. A social liberal in American terms, Weiner is so blinded by his allegiance to Israel and so studied in his ignorance of the Middle East that he has played a uniformly sinister role in that aspect of foreign policy. If he were replaced by, say, an up an up-and-coming Dominican-American politician from Queens who had some sympathy with Arabs, that would be all to the good.
Weiner:
1. Called for Columbia University professor Joseph Massad to be fired for being critical of Israel; Weiner thus spearheaded a new McCarthyism.
2. On the Israeli attack, in international waters, on the Mavi Marmara relief ship, Weiner sputtered: “”If you want to instigate a conflict with the Israeli navy it isn’t hard to do. They were offered alternatives. Instead they chose to sail into the teeth of an internationally recognized blockade.” The blockade of Gaza civilians is a breach of international law; it is not internationally recognized and has on the contrary been condemned by almost every nation and human rights organization.
3. Alleged that the New York Times is anti-Israel: “Amnesty International in particular, has always had bias against Israel, and frankly I would argue that in many cases, the New York Times has, as well.”
4. Alleged that the Palestine Liberation Organization is still listed by the US as a terrorist organization. It was dropped from the list over 2 decades ago.
5. Tried to bar the Palestinian delegation to the United Nations from New York.
6. Alleged that Mahmoud Abbas, President of the Palestine Authority, is not the head of the PLO. He is.
7. Refused to condemn the use by Israel of cluster bombs on the civilian farms of south Lebanon in 2006.
8. Alleged that the Israeli army does not occupy the West Bank and that there is no Israeli Army presence in the West Bank.
9. Called Israel’s war on Gaza a “humane” war. 400 children were killed.
10. Voted for Iraq War authorization in 2002, before later turning against the war.

حقنا ناقص يا مجلس الشورى ؟!

يُشكر من الأعماق مجلس الشورى على تفاعله مع قضايا المرأة، فأخيرًا وبعد طول جدل يقر أكثر من ثلثي أعضائه بالحق الشرعي للمرأة في المشاركة في الانتخابات البلدية، ولكن ــ للأسف الشديد ــ لم يقر بالحق الشرعي كاملًا؛ إذ منحها جزءًا منه ،وهو حق التصويت، وحجب عنها حق الترشيح، وآية البيعة التي استند عليها المجلس في مشروعية حق المرأة في الانتخاب ،وهي الآية (12) من سورة الممتحنة، والتي جاء الخطاب فيها على التخصيص للنساء للتأكيد على استقلالية بيعتهن عن بيعة الرجال، وعدم تبعيتها لهم، تأكيدًا على نقصان مشروعية أية عملية انتخابية دون مشاركة المرأة فيها، فالبيعة، أو الانتخابات ناقصة الشرعية إن أُقصيت المرأة عنها، هذه الآية التي أعطت للرجال والنساء حق البيعة، أعطتهم أيضًا حق المُبايعة أي حق الترشيح، فكما للرجل حق الترشيح، فللمرأة كذلك، وهذا الحق منحته جميع الدول الإسلامية للمرأة ، حتى المملكة العربية السعودية منحته للمرأة في انتخابات الغرف التجارية والصناعية ،ومؤسسات الطوافة والأدلاء، والجمعية الوطنية لحقوق الإنسان ،وهيئة الصحفيين، ومؤخرًا الأندية الأدبية، فلماذا يستأثر به الرجل في المجالس البلدية؟

فإن كانت هناك مخالفة شرعية في منح المرأة حق الترشيح في مؤسسات يشترك فيها الرجال والنساء ،كالتي ذكرتها ،فكيف مُنحت حق الترشيح فيها؟

إن كان استناد مجلس الشورى على حديث « لن يفلح قوم ولوا أمرهم امرأة» فهذا الحديث جاء بخصوص السبب، وليس بعموم اللفظ، فقد قيل بمناسبة تولي امرأة الحكم في فارس، لأنّه قُتل كل ذكور الأسرة الحاكمة، فعندما توفي كسرى الفرس لم يوجد من يخلفه من الأسرة الحاكمة إلا امرأة، وعندما علم الرسول صلى الله عليه وسلم بذلك قال « لن يفلح قوم ولوا أمرهم امرأة» أي لن يفلح حكم هذه الأسرة ،وهي خالية من الرجال، للأسف هذا شأن خطابنا الديني يتشبث بظاهر الآيات والأحاديث ليقلل من شأن المرأة، ويحرمها من حقوقها الشرعية، فالذين يأخذون بظاهر هذا الحديث أين هم من قوله تعالى : (وَإِذَا حَكَمْتُمْ بَيْنَ النَّاسِ أَنْ تَحْكُمُوا بِالْعَدْلِ ) الخطاب هنا على صيغة العموم ؟

بل وأين هم من قوله تعالى ( والمؤمنون والمؤمنات بعضهم أولياء بعض يأمرون بالمعروف وينهوْن عن المنكر) ؟

فهذه آية صريحة وواضحة في منح المرأة حق الولاية، والله جل شأنه عندما أورد قصة ملكة سبأ لم يوردها عبثًا، فقد بيّن كيف كان حكمها (قَالُوا نَحْنُ أُولُو قُوَّةٍ وَأُولُو بَأْسٍ شَدِيدٍ وَالْأَمْرُ إِلَيْكِ فَانْظُرِي ماذا تأمرين) فدولتها كانت قوية، ولو كان حديث « لن يفلح قوم ولوا أمرهم « على العموم لما فلح قوم سبأ بتولي امرأة عليهم، والسنة لا تناقض القرآن، فهذه الآية تؤكد أنّ حديث « لن يفلح قوم ولوا أمرهم امرأة» جاء بخصوص السبب، وليس لعموم اللفظ ، فقوم سبأ بإقرار من القرآن الكريم فلحوا في الدنيا والآخرة، فكانوا أولي قوة وبأس شديد في الدنيا، وفلحوا في الآخرة لإسلام ملكتهم بلقيس؛ إذ أسلموا معها.

وإن قيل إنّ سبأ كانت دولة وثنية، فأقول: ممّا أثبته المفسرون أنّ سيدنا سليمان قد أقر ملكة سبأ على حكم اليمن بعد إسلامها، وإن كانت دولة وثنية ،فالقاعدة ثابتة لا تتغير، فالمرأة إن كانت غير صالحة للولاية، فهي غير صالحة سواء كانت دولتها وثنية أو مسلمة أو مسيحية، وأنت لو تتبعت تاريخ الأمم التي تولى النساء الحكم فيها بمن فيها الأمم المعاصرة، لن تجدها لم تفلح لتولي النساء أمرها، فالتاريخ لم يُسجل أنّ امرأة حكمت، طغت وتجبرت على شعبها، كما سجل ذلك على رجال حكموا، بل سجل التاريخ نساء حكمن بالعدل والقسطاس، وازدهرت الحياة العلمية في عهودهن، مع انتشار أعمال البر والخير، وهذا ما رصدته من خلال دراسة قُمتُ بها عن أحوال الأمم التي تولى أمرها نساء، وسأضرب المثل برضية بنت التمش: ملكة من ملكات الهند كانت ذات سلطة ونفوذ وإدارة ،ارتقت الملك سنة 634هـ بعد خلع أخيها ركن الدين فيروز شاه، وهي خامس ملوك دولة المماليك بالهند، وقد أبى الأمراء في أول الأمر أن يقسموا لها يمين الطاعة، ولكنها بحزمها وحسن تدبيرها تمكنت من إخضاع البلاد كلها لسلطانها، وكانت السلطانة رضية تملك كل الصفات التي تؤهلها لتولي الملك، وإدارة شؤون المملكة، فكان والدها إذا تغيب في حروبه ينيبها عنه في إدارة أعمال حكومته مفضلاً إياها على أبنائه الذكور، ولمَّا سأله أمراؤه لماذا اختار ابنته بدل أحد أبنائه في نيابة المملكة، أجاب: «إنَّ أولاده انهمكوا في الشرب واللعب فإدارة المملكة صعبة عليهم، أمَّا رضية بيكم ــــ لفظة فارسية معناها أميرة ـــ فمع إنَّها امرأة لكن لها عقل وقلب رجل»، ولمَّا تبوأت عرش المملكة أظهرت من حسن الإدارة ما يؤيد هذا الوصف عنها، فشرعت تباشر أعمال المملكة بنفسها وتنظر في القضايا المعروضة عليها، وتفصل فيها بالعدل والقسطاس المستقيم، وكثيراً ما قادت جيوشها بنفسها ،وتآمر أخوها على خلعها، حسداً منه لما بلغت من مكانة، ولم يفلح، وتوفيت سنة 637هـ. وممّا يستدعي التوقف عنده للتأمل أنّ 37 من أعضاء المجلس عارضوا مشاركة المرأة في الانتخابات البلدية، وهم يعلمون أنّ الخالق جل شأنه أعطى المرأة هذا الحق ،والآية القرآنية واضحة وجلية ،والسنة الفعلية تؤكد ذلك، و يعلمون بلا شك أنّ أول محتسب في الإسلام امرأة هي الشفاء بنت عبد الله من بني عدي ولاها على الحسبة مؤسس الحسبة سيدنا عمر بن الخطّاب رضي الله عنه ، فهل المعارضون أعلم من الخالق بما يصلح لخلقه؟

فأرجو من مجلس الشورى أن يعيد النظر في قراره ، ويكمل ما فيه من نقص بإقرار حق المرأة كاملًا في انتخابات المجالس البلدية تصويتًا وترشيحًا.
